The above statement given by Henry Kissinger should dispel any possible doubt or confusion in the skeptics among us as to just how little our servicemen matter to the elitist madmen calling the shots. No longer do they spew empty words to placate the masses. They are admitting outright that our soldiers are expendable and disposable. If the above statement by Kissinger doesn't make your blood run cold, then tell me, what will?

While the war-mongers relentlessly push us into a war nobody else wants, our troops are scattered far and wide, preparing for the unpredictable and seemingly inevitable confrontations which lie ahead. Some are saying this war will lead to peace. The absurdity of such a statement is apparent. Why must we engage in war to obtain peace? What will be the ultimate price of such peace? How many American lives must be sacrificed as collateral damage to purchase this "peace"? How many of our sons and daughters will die in order for the Controllers to achieve their insidious ends? It's beyond horrible to consider. . .

Americans do not believe anything can touch them or hurt them. Not really. Many of our people are still disconnected from the big picture, simply because nothing horrible is happening in their own backyards. I hearken back to 9/11/2001, and remember the disconnection of some of the people in my life to that unforgettable mass murder. I couldn't believe it then, and I still have a hard time with it. America, when are you going to realize that what happens to SOME of us happens to ALL of us?

Our young men and women are steadily disappearing into Bush's War Machine, where they will be forever changed. They don't realize just WHO they're fighting FOR. They don't know because our fine military leaders aren't going to tell them. They don't need to know - because our war-crazy leadership isn't going to tell them either. They are viewed as "dumb, stupid animals to be used as pawns for foreign policy", remember? And still they enlist, never realizing perhaps, until it's too late, that they've put their very lives in jeopardy for the true "evildoers", the plutocrats designing this war to suit their heinous schemes.

These "dumb, stupid animals" are OUR children and they're being shipped out and set up to die on foreign soil. How does this sit with you? It makes my blood BOIL. And while I will do my best to dissolve the smoke; mirrors clouding my son's thinking, the writing is already on the wall. The Machine wants to chew up another "dumb, stupid animal" - my child.

I'd like to ask Henry Kissinger to personally explain his statement to me and all the other American mothers and fathers out there whose children are gearing up to fight this obscene war under false pretenses.

My message to George Bush and the rest of the lunatic Machine is: ”I'll see you all in HELL. Don't be late.”

Brother and sister have been separated since Nov.9,2006...

Although my daughter resides with me, she has had very limited contact with her brother (less than 8 hours). I have had none.

From day one, when a protection worker first stepped into my home, they have been a cure looking for a disease.

My son had been placed in a foster home by the children's aid society. He has recently been removed from there. Now he is in a Youth Crisis Center. Update November 28/07 he is now in a group home.

I am sure he is there because he is acting out his frustration caused by the emotional abuse of being taken away from his family.

This was a happy kid living in a happy home!

When social workers make mistakes it becomes more and more about covering up sloppy work and the integrety of the agency, and less and less about a "child's best interest"

False allegations, and findings being made with no evidence, must come to a stop.

As thousands of reports in Spain emerge of doctors having stolen babies from new mothers and sold them into adoption, we follow some of the victims in the search for their biological parents.

German Gallego shows us a photograph of a dead baby. She is frozen, her little limbs twisted as she rests in the freezer, kept so that nurses could produce her to deceive parents into thinking their child was dead. Apparently, "many doctors became very wealthy doing this". It was something they had learned from Franco's social engineering programme and turned into a money-making operation. Many of these doctors are still alive and some may even still be practising. "There is no identifying information. It has just vanished", says Randy, who was sold to an American family. The destruction of the paper trail has frustrated the search for his biological mother. For thousands of mothers in Spain, who may or may not have had their children die during the period these abductions were prevalent, it has meant anger and doubt. Nuria, whose sister apparently died stillborn, is having her sister's grave opened for a DNA check. However, for some, like Vicen, having the truth emerge and knowing there is a chance of finding her children offers hope of a new start. "I know that it is very difficult to find them but now I have a motive to continue living".

It is no surprise that the Catholic Church has once again been caught in yet another child trafficking scheme - this time in Spain.

The Protect Your Children Foundation is keeping track and exposing the organized crime of the Catholic Church so far in order to alert and warn the nations. The Catholic Church has murdered over 50,000 native children in Canada at Residential schools administered by nuns, 500,000 children stolen by nuns in Catholic Mother-Baby homes in Australia, another 500,000 in Canada. Not to mention more than 30,000 women tortured and abused in Ireland's Magdalene Laundries and more than 30,000 children abused in the Catholic residential schools of Ireland - to name a few.

No longer can the nations deny that these are isolated cases. It is obvious that the organization known as the Catholic Church is the worst criminal organizaiton in existence, utilizing the Lord's name to gain trust and commit crimes against humanity.

Searching for Spain’s Stolen Babies

ZARAGOZA, SPAIN—In November 1974, Luisa Fernanda Marin Valenzuela stood in a doorway at a medical clinic. A male nurse held one arm and a nun held the other. About 36 hours earlier, she had given birth to a baby boy. Far across the room, she could see a tiny baby’s naked body on a table. They told her it was her dead son.

She wanted to get closer, to hold him, to cover his cold skin, perhaps even whisper his chosen name, Antonio. But the nun and nurse refused to let Luisa, who was wracked with grief, move closer to the child. Instead, they led her away.

“She’s going to faint, she’s going to faint,” she remembers them saying as they pulled her back. “Take her home.”

It was the first and only time Luisa saw the baby they said was her son. Thirty-seven years later, she is convinced it wasn’t him. She, like hundreds of other mothers across Spain, believes her child was stolen.

What began as a trickle of revelation about General Francisco Franco’s ideological cleansing by taking children from their parents is now a fully engaged scandal in a country wracked by debt, unemployment and civil unrest. As many as 300,000 babies, Spaniards have been told, were wrested from their mothers between 1960 and 1989 by a network of doctors, midwives, priests and nuns who then sold them to infertile couples for huge sums.

The scandal emerged four years ago, when a dying father revealed to his son, Juan Luis Moreno, that he and a childhood friend, Antonio Barroso, had, in fact, been bought from a priest and a nun for about 200,000 pesetas each in 1969, money that could have bought a small flat. Pesetas were the Spanish currency until 2002.

Nobody knows for sure how many children — and parents — are living false lives. Nearly 1,000 lawsuits have been filed in courts ill-prepared to handle them. And with the scandal has come a stream of shocking details — tiny corpses kept in freezers as decoys to show grieving parents; nuns with million-dollar real estate holdings and caskets exhumed after decades found empty.

Plunged into uncertainty, questioning mothers and children are paying hundreds of euros for their own DNA testing; the results are ripping their families apart.

So far, six stolen children have been reunited with their biological families, providing many with hope that their long lost children are alive. It is only now that many have even considered the prospect that they may have been told something other than the truth, including Luisa.

She is 70 now, a mother of nine and grandmother of seven. Remembering those moments long ago, she wipes tears from her eyes again and again.

“You can overcome death. It takes a long time, it’s very painful, but you can overcome it,” she says. “But the uncertainty of not really knowing . . . that really is shattering.”

The stories of the many grieving mothers bear striking similarities. Many were anesthetized during labour. When they awoke, they were told their babies had died. Many never held their babies, or even saw them.

Stolen babies have a long history in Spain. During the reign of General Francisco Franco (1936-1975) tens of thousands of children were stolen, beginning in the 1930s. Children were taken from left-leaning parents and placed with more politically suitable families to protect their “moral education.” Others were taken from single mothers and given to “proper” Catholic homes.

“In Spain, the precedent was really set during the civil war,” said Antonio Lafarga Sábado, Luisa’s husband. “But the weird thing is, it just carried on. It didn’t stop.” [Why would it? A lot of people were making a lot of money. This is a warning to ALL countries everywhere. This happens everywhere because there are greedy hard-hearted people everywhere and as the economic sytem gets worse, there will be more and more people who will be willing to sell their souls and sell your children. ]

As Spain became a democracy, those with access to newborns appear to have carried on the tradition because the trade was so lucrative.

The story of Moreno and Barroso, who grew up in Vilanova i la Geltrú, a seaside town about 50 kilometres south of Barcelona, started the avalanche of current courts cases. After the elder Moreno’s deathbed confession in 2007, so much made sense. Moreno understood why he towered over his diminutive father and looked nothing like his mother.

The childhood taunts Barroso endured in the schoolyard — children claiming he wasn’t really his mother’s child — came rushing back. She’d always insisted their claims weren’t true, and even told him vivid stories about her labour pains.

When Barroso was in his teens, he went to a local registry office and pulled a copy of his birth certificate, which listed the name of his adoptive mother; the staff insisted there could be no mistake. He put it out of his mind until the confession came; by that time he was 38.

“I’d always suspected it,” Barroso, 42, says, fiddling with a copy of his inaccurate birth certificate. “When I was young, there was no real way to confirm it, but now, with DNA tests available, the whole thing becomes so much clearer that all my life has been a lie.

“I’ve been lied to and I’ve been fooled.”

The men took DNA tests that confirmed the dying man’s story. Barroso has since abandoned his career in commercial real estate. He has filed lawsuits at every level in the Spanish court system and founded the National Association for Victims of Irregular Adoptions (Anadir).

More than 1,800 people are members of the group, which maintains a DNA database for parents who fear their babies were stolen, and people who suspect they were trafficked.

About 930 lawsuits have been filed. The majority have been rejected; judges cite statutes of limitations, a lack of evidence and the fact that key witnesses are dead.

Spain’s laws have also made investigation difficult. Babies that die within 24 hours are considered aborted fetuses and are often buried together in their own section of cemeteries — making it hard to extract DNA evidence, according to Lorenza Álvarez, who is coordinating the stolen baby cases for Spain’s attorney general’s office.

Still, a small but growing number of cases are proceeding. Tiny graves are being exhumed throughout Spain. Some are empty; others contain only wads of medical gauze or bandages, not tiny bones.

In two caskets, investigators found remains that have no genetic link to their supposed parents — evidence, Barroso reasons, that the babies were swapped with those of couples who had stillborns.

One woman has told reporters that in 1969, a priest encouraged her to fake a pregnancy until a child became available for purchase. And a man who drove babies’ caskets to a cemetery in southern Spain says at least 20 of the boxes were far too light to hold children’s remains — or, for that matter, to hold anything at all.

Spanish journalists who investigated a clinic in Madrid that is listed in many legal claims found a baby’s corpse in its freezer. There have been suggestions it was kept there to show parents who demanded proof their children had died.

The scope is staggering. Barroso feels he is single-handedly leading the charge for justice. He is tired; dark circles hang beneath his eyes as he explains his frustration.

“It’s shameful that Spain, which likes to presume to be a law-abiding society, one that wants to give the impression of being a democratic, modern society, should have had this going on,” Barroso said. “You basically have to laugh so as not to break out crying.”

When Barroso learned he had been bought, his mother was ill. He surreptitiously swabbed her cheek for DNA tests that proved she was not his biological parent. She eventually confessed that a nun she had befriended did her a favour.

He and Moreno followed the trail to another nun, now 85, and in hospital. The men have visited her several times — hoping she will reveal the names of their real mothers. But she has revealed nothing.

“She remained absolutely unmoved,” Moreno says. “She said her conscience was at peace. She helped mothers in a disgraceful situation. She had nothing but peaceful thoughts.”

The nun has not been charged with any crime. The Roman Catholic Church has not commented.

Barroso and Moreno have learned that she owns seven properties, estimating her worth at one million euros (nearly $1.4 million Canadian). One of the properties was inherited and another was donated, but the remaining five appear to be outright purchases.

“How is it possible that a nun with espoused vows of chastity, poverty and obedience should be worth so much money? How has she accrued so much property?” Moreno asks.

Moreno and Barroso have presented their lawsuits at all levels in the Spanish court system, but they have been consistently rejected.

In January, Anadir presented 261 cases to Spain’s attorney general and held a rally in an attempt to draw public attention. It was then that the government took the issue seriously and began referring cases to provincial judges.

The prosecutor’s office has since authorized exhumations and some cases are proceeding, Álvarez said.

Luisa’s case is not among them. Her lawsuit was dismissed in late September because the midwife and doctor are both dead.

Sitting in her living room, surrounded by family photographs, she fingers a photocopy of the burial record from the cemetery that contains her family niche.

At the clinic, she was told her newborn had died around 11 a.m. on Nov. 24, 1974, about 36 hours after his birth. She says she refused to leave the clinic until she saw his body.

But the burial record shows that by the time staff showed her the baby’s body, he would have already been buried.

What’s more, her husband Antonio clearly remembers picking up his son’s remains and taking them to the cemetery the following day, on Nov. 25. But that date does not appear in any of the records.

The couple, who were then in their 30s, trusted their doctor and the clinic. They had already delivered two healthy girls with his help.

“All my children have been born perfectly healthy,” Luisa says.

“The likelihood here was that this boy was going to be a very healthy little boy. That’s why I think it happened to us.”

She returned to the same doctor for four more births. Strangely, he waived his fees for one birth. Did he feel guilty, they wonder.

Their flat is always bustling with activity. Down the hall, some of their daughters and grandchildren have gathered for a family lunch.

One of their granddaughters scampers down the hall for a kiss on her way to school. Luisa gives her a tight hug.

“Other people say, ‘Listen, you’ve got nine and they’re all extremely healthy,’” Luisa says. “But there’s one that’s missing.”

“There is one missing,” echoes her husband.

The devastated grandparents were told they would never see the youngsters again unless they dropped their opposition.

The couple, who cannot be named, wanted to give the five-year-old boy and his four-year-old sister a loving home themselves. But they were ruled to be too old - at 46 and 59.

For two years they fought for their rights to care for the children, whose 26-year- old mother is a recovering heroin addict.

They agreed to an adoption only after they faced being financially crippled by legal bills.

The final blow came when they were told the children were going to a gay household, even though several heterosexual couples wanted them.

When the grandfather protested, he was told: 'You can either accept it, and there's a chance you'll see the children twice a year, or you can take that stance and never see them again.'

The man said last night: ' It breaks my heart to think that our grandchildren are being forced to grow up in an environment without a mother figure. We are not prejudiced, but I defy anyone to explain to us how this can be in their best interests.'

Social workers themselves have admitted that the little girl is 'more wary' of men than women."

Boy, 5, forced into adoption with gay couple pleads: 'We want to stay with our gran and grandad'

The mother of two children who are being adopted by gay men even though their grandparents want to care for them wept yesterday as she told of her final meeting with her son and daughter.

‘I told them, “Listen, Mummy is not going to see you for a while”,’ she said. Her son replied: ‘But Mummy, I want to come and stay with you and Granny and Grandad.’

The row over the future of the five-year-old boy and four-year-old girl intensified yesterday after the Daily Mail revealed details of the heartbreaking case. Their grandparents spent two years fighting for the right to care for the children, whose 26-year-old mother is a recovering heroin addict. She desperately wanted her parents to look after them.

But social workers said their ages – he is 59 and she is 46 – and their health – he has angina and she is diabetic – ruled them out.

The mother told the Mail that she had been ordered to say her goodbyes to the children last August during a trip to Edinburgh Zoo. ‘They told me not to cry and be strong so as not to upset the children,’ she said. ‘How can you tell a mother that when she’s never going to see her children again? ’

She voiced her anger at the decision to allow her son and daughter to be fostered by a homosexual couple.

‘I did not under any circumstances want my children to be placed with gay men. I wanted them to have a mum and a dad.

‘They can’t be telling me that, within a 60-mile radius, the only people they could find to look after my children were two men.

‘I’ve got nothing against gay people

‘I’m ashamed of what I’ve done, especially what I’ve put mum and dad through because they have been brilliant every step of the way.

‘My children deserve so much love and my mum and dad were prepared to give them it, but social work snatched them away.

‘They are a mum and dad in a million and I know they would have brought my children up brilliantly.’

The mother also revealed that social workers have asked her to meet the gay couple under their supervision. But she will not see her children – or be allowed to know where they are going to be living.

The Mail revealed yesterday how the grandparents had fought a relentless battle for the right to look after the youngsters after deciding their daughter was unfit to do so.

But they were opposed every step of the way by Edinburgh’s social work department, which believed they should go to an adoptive family.

When the grandparents eventually caved in to what they describe as ‘bully tactics’ by the social workers, the department arranged for the children to be adopted by a gay couple in the Edinburgh area. They had already decided that, whatever the outcome of the battle, the children should not see their mother owing to her unstable lifestyle and history of offences.

Recalling her final, 90-minute meeting with her children, the mother said: ‘I was told that this would be the last time. They asked me to pick a place to take them and I decided on the zoo. The social worker was with me and kept saying to me I would have to tell them I was not going to see them any more and that I had to stay strong for their sakes.

‘At one point she said that my son was the spitting image of my mum and my daughter looked like her grandad. What kind of thing is that to say at a moment like that, when I’m about to tell them I won’t see them again?

‘I told them that I loved them and I would write them lots of letters and cards [ This would NOT be allowed in US or Canada ] and that they would be going to a new house soon.

‘I got really upset and had to keep turning away so that they didn’t see me crying. The social worker said, “Just leave it there”. Ten minutes later, that was it.’

But the mother still had to help put the children in the social worker’s car. ‘My son grabbed me tightly on the leg and and would not let me go. It was just absolutely devastating.’

She said that the heartrending last meeting had happened while her parents were still fighting for full parental rights for the brother and sister, who have been staying with foster parents for the last two years pending a decision on their future.

Her parents’ last meeting with the children came two months later in October. By then, under mounting pressure from the social work department and concerned about months or years of further disruption to their lives, they had taken the agonising decision to withdraw from the legal fight.

The grandfather, a farm worker, and his wife say the social work department are effectively blackmailing them by telling them they will not see the children again unless they give the new adoptive arrangements their blessing.

Although the family desperately want to reverse the adoption procedure they do not now know how they can. Their previous solicitor has moved to a new job and would be unable to represent them in her current role. They would also need to reapply for legal aid before taking any action – and time is running out.

The children have already had several meetings with the men who are soon to become their full-time fathers. They are understood to be seeing them for a few hours daily and have recently visited their home. The men are giving them a bedroom each – and the girl’s has been decked out with a ‘princess’ bedspread. The children have also been shown the wellington boots waiting for them at the back door when they want to play outside.

Under the adoption procedure, the children will see more and more of the gay couple, spending occasional nights in their home, until they move in permanently. The social work department will remain in contact with the new parents for the first year of adoption – then, providing there are no serious problems, contact will cease.

Thereafter the only official channel the children’s natural family will have for making contact with them would be through an adoption agency. The mother said: ‘The social worker told me the kids are getting on really well with them. My daughter had apparently said to the social worker, “Come up and see my princess bed”. I just feel totally devastated.

Now they want me to meet the men. [Again, this would not be allowed in the US and Canada] Social work phoned me to ask how I was feeling now about them being adopted by a gay couple and if I had calmed down.

‘They told me that out of the couples they had on their books they were the ones who were able to cater for their needs best. I find that very hard to believe. I’ll have to say that to them when I meet them because it’s how I feel, but I don’t want the whole thing to become an argument. I will have lots of questions to ask them.’

Councillor Marilyne MacLaren, convener for education, children and families at Edinburgh City Council, said: ‘I have been assured that the professional view is that the adoptive couple will provide a safe, secure and loving environment for these children.

‘These are always very complex cases but I think it is important to say that the grandparents have been fully involved in discussions about this case over a period of time.’

Do social workers have grandparents? One is bound to ask this question when you hear of cases like that of this Edinburgh couple aged 46 and 59 respectively.

In the minds of some social workers there seems to be a real prejudice about age which makes them turn to foster care and adoption, rather than care by grandparents.

After all, Cherie Blair was 45 when she had her fourth child, and Tony Blair was 47 - did anyone seriously suggest that they were too old to be parents?

What has happened to the Edinburgh couple is all too often reflected in some of the 8000 calls that the Grandparents’ Association advice line receives each year.

Distressed grandparents call for support and help, such calls taking 20-25 minutes, as sad stories of grandchildren being 'lost' to care and adoption are related.

Grandparents have no rights, or standing, in respect of grandchildren in England and Wales (they do in Scotland). Frequently they are ignored, or dismissed as potential carers, by social services.

Of course not all grandparents are suitable, or willing, to provide full time care for grandchildren. But many are - and will undergo financial loss by giving up work - when asked to take on the responsibility of providing a loving and secure family home for a grandchild.

The professionals who are concerned with children in crisis have to take difficult and complex decisions in a highly emotional field. Such decisions will echo down the years for a child, often well into adulthood.

A social worker at the centre of the gay adoption row told the children's grandparents they will never see them again because of the publicity surrounding the case.

Heather Rush telephoned the youngsters' 26-year-old mother after the family publicised their grievances with her council department.

Mrs Rush allegedly said the price they will pay for speaking out is complete loss of contact with the five-year-old boy and four-year-old girl.

The children's mother, who had been due to meet the two adoptive fathers under social workers' supervision next week, took the call from Mrs Rush on Wednesday.

The mother, who cannot be identified, said: 'She asked me if I had seen the paper and said "it does not make very good reading".

'I said I didn't think it was right that she was not letting me meet the fathers because of the story going in the paper and that she should speak to my Mum and Dad.

'She said, "No, just pass the message on." She said she didn't want to speak to them but there would be no recommendation for them to see the children twice a year.'

Last week Mrs Rush had told the grandparents they would be allowed to see the boy and girl if they gave the gay adoption arrangements their blessing.

But now the 39-year-old - who has two children herself by different fathers - appears adamant that even if they do accept the arrangements they will not be given access.

The forced adoption of the children by two gay men - and the council's decision to ignore their grandparents' request to care for them - has provoked fierce debate.

An Edinburgh councillor described the call to the vulnerable mother, who is currently taking methadone in an attempt to kick her drug habit, as 'unprofessional, inappropriate and unacceptable'.

Jeremy Balfour, a Conservative, said: 'It is not an acceptable way to treat people. It seems to me to be a case of throwing toys out of the pram.

'I don't think such a call could be motivated by the best interests of the children.'

An Edinburgh council spokesman last night denied that a social worker told the mother her parents would never see the children again.

Gillian Tee, Director of Education, Children and Families, said: 'We have no reason to doubt that the staff who have worked on this case have handled it with anything other than professionalism and sensitivity. We have not received a complaint from the family.'

Social workers gave the young mother just 90 minutes to say goodbye to her two children before they were taken away forever.

The mother was allowed to take her young son and daughter to Edinburgh Zoo before they were separated.

The mother earlier told the Mail: 'They told me not to cry and be strong so as not to upset the children.
'How can you tell a mother that when she's never going to see her children again?'

She added that the children themselves said they wanted to stay with their grandparents. She is unable to care for them as she is a recovering heroin addict.

The boy's father was a schizophrenic who killed himself two months before his son was born. The girl's father is still alive but has had nothing to do with his daughter.

Did the children torn from their grandparents to be adopted by the gay men fall prey to a politically correct social services agenda?

The photograph on the mantelpiece of their grandparents' home outside Edinburgh seems particularly poignant today.

It shows a baby girl in a pretty red dress and her smiling brother enjoying ice-cream in Princes Street gardens in the city centre. Underneath someone has written: ‘You bring so much joy and laughter.’

They say the camera never lies. But this picture does; figuratively, anyway.

For just hours after it was taken, the lives of these youngsters changed for ever and a heartbreaking domestic drama turned into a scandal that is still unravelling and causing untold anguish.

Now scandal may be too strong. So too ‘blackmail’, ‘brutal’ and ‘bullying’.

Yet few who are familiar with the story — or have been caught up in the sometimes harrowing process of adoption themselves — would dispute their sentiment.

For, as many of you will be aware from our reports this week, the children’s mother is a recovering heroin addict.

The father of her five-year-old son was a schizophrenic who hanged himself two months before he was born. The father of her four-year-old daughter disappeared long ago, after making another woman pregnant.
It would be hard to imagine a more tragic or traumatic set of circumstances.

But the one — indeed only — source of stability and support in the lives of these youngsters (we can’t identify them for legal reasons but we shall call them Stewart and Fiona) were their grandparents.

They insist social workers said: ‘Stewart and Fiona’s contact with their grandparents is very positive, and it is a warm and enjoyable environment for them to be in.’

Here, for the first time, we piece together the chain of events that resulted in Stewart and Fiona being removed from that ‘warm and enjoyable environment’ and placed with a gay couple.

When the Mail broke the story on Wednesday there was a public outcry. Religious leaders and family groups were incensed. The Tory group on the Edinburgh city council has called for an inquiry. So how could it have happened?

It is certainly a harrowing journey. The love their grandparents felt for Stewart and Fiona, and they for them, is apparent to anyone who visits their bungalow, where the children were brought up almost from birth.

On the sofa are Noddy and Bunny, the cuddly toys they once played with. One card, penned in glitter, from Stewart says: ‘I love you Grandma’, another, from Fiona, says:

‘Love you Granny.’ Their christenings, first day at nursery, and trips to the beach are chronicled in photo albums.

And, of course, that picture on the mantelpiece. It was taken shortly before Stewart and Fiona saw their grandparents for the final time on October 7 last year.

At about 4.30pm that day they were dropped off at a building in Oxgangs, Edinburgh.

The graffiti-scarred concrete block, of the kind still common in Eastern Europe, is where the social services department is based, and as a metaphor for what was about to happen, these soulless surroundings are apt.

Inside was social worker Heather Rush, 39. Mrs Rush is no more or less to blame than her colleagues. Yet her attitude, you might think, typifies the brutally insensitive, bullying manner in which Stewart and Fiona’s grandparents say the children were treated.

One scene, on the ground-floor corridor of the Oxgangs building, still haunts the family. ‘Excuse me, can I speak to you?’ Stewart, politely asked Mrs Rush moments before the emotional handover.

‘Yes, what is it?’, she replied. Stewart then told her: ‘I don’t want to go. I want to stay with my granny and grandad.’ Stewart’s understandable anxiety was, says his grandfather, met with thinly disguised irritation, if not anger.

‘No, that’s not possible, you can’t stay with them,’ Mrs Rush replied curtly. ‘Now go and get your stuff.’ Instead, Stewart sat down, covered his face with his hands, and cried.

‘I thought the way Stewart was treated was appalling,’ said his tearful grandfather. ‘I told her [Mrs Rush] that she had no right to speak to a child like that. But she ignored me.’

You may wonder why Stewart and his sister had to go through this. After all, didn’t their grandparents provide a ‘warm and enjoyable environment’ for them to grow up in the absence of their mother?

Officially, at least, the couple were told they were too old to look after the children permanently — even though the grandmother is only 46, and her husband 59.

But after pressure from social services and concern about further disruption to the youngsters’ lives, the grandparents took the agonising decision to withdraw from the legal fight to keep the children.

If they knew then what they know now, they would never have done so.
The ‘incident’ in the corridor of the Oxgangs office, they soon discovered, was not an isolated one. Nor, it seems, was the attitude of Mrs Rush.

It was Mrs Rush — who has two children herself by different fathers — who contacted them again. She had some ‘good’ news. They had found a new home for Stewart and Fiona. They were to be placed with a ‘male couple’.

The children’s grandmother burst into tears. Their grandfather was furious.
You might have expected such sensitive information to have been delivered in person. In fact, it was imparted over the phone — with a warning: support the adoption or risk never seeing Stewart and Fiona again.

The family are not homophobic; they have a number of gay friends. But if believing that children are best raised by a mother and father living together constitutes homophobia, most people probably are.

In 2006, the Scottish Parliament approved adoption by gay couples — despite an official consultation that showed nearly 90per cent of Scots were against the move.

The family had not heard the last of Heather Rush. On Wednesday afternoon she was on the phone to Stewart and Fiona’s 26-year-old mother, after the story first appeared in the Mail. ‘Tell your mother, that’s it,’ Mrs Rush snapped. ‘No contact.’

The front-page article, she claimed, would not make ‘good reading’ for Stewart and Fiona when they were older. Not good for them, or not good for Edinburgh social services?

A document the family produced shortly after Mrs Rush phoned on Wednesday made rather better reading. At least for Mrs Rush.

It’s called ‘Having Your Say At Your Review — Young Person’s Report’. A review, the preamble explains, is ‘where changes can be made to your care plan’.

Respondents are encouraged to give their views by ticking a series of boxes. One such form was filled in for Stewart by Mrs Rush on November 28, 2008 — just weeks after he had broken down in the corridor.

Question: I see my social worker, too much, about right, not enough?

Answer: The ‘not enough’ box is ticked. In the space below an adult has added: ‘I’d like to see Heather more.’

Question: Are you happy with the contact you have with your family and friends?

Answer: The tick appears in the box marked ‘yes’.

Question: What decisions would you like made at your review?

Answer: ‘I would like Heather to find me a new family’ is the answer written underneath.

Are we really to believe those answers represented Stewart’s true feelings? Most children of this age are keen to please and will reply in a way they think the adult wants them to.

Listening to children and trying to meet their needs is one thing, politically correct propaganda another.

The family of Stewart and Fiona are in little doubt about which category the reports falls. In one way, the pernicious culture of political correctness is at the heart of this story.

‘This happened because the family is Scottish and working class,’ said a woman who, until recently, was a senior social services manager in the Edinburgh department.

‘Any social worker who, for example, presented the black parents of a black child with the kind of ultimatum that the family of Stewart and Fiona were given, which risked the child losing contact with cultural and family ties, would be sacked.

‘Political correctness is a big issue in local government, especially in social work. I am not aware of any official quota system, say, to ensure a percentage of adopted children go to gay parents.

But if you ask me, could it be happening informally in certain areas that like to be seen as progressive — and that usually means the big urban authorities? Then, yes, I believe it is more than possible.’

Recent figures suggest almost 3,000 drug addicts in Edinburgh have children at home who are at risk of abuse or neglect. In Edinburgh, it seems, drug addicts are thought to make better carers than loving grandparents.

The grandparents in question have seven children of their own. Two of them, aged 15 and 13, are still at school. Their 17-year-old also lives with them, while the rest of their children, who are all older, live away from home. All are making their way in life.

The mother of Stewart and Fiona is their eldest child. For the past six months she has been on a methadone programme to help her kick her longterm heroin addiction.

Over the years, she has suffered domestic abuse in a series of relationships and has been convicted of many offences, including theft and breach of the peace. She is not a bad person, just a troubled one.

‘I’m ashamed of what I’ve done and what I’ve put Mum and Dad through,’ she says.

‘They have been brilliant every step of the way.’ They are not perfect, of course. Nor would they pretend to be. Their bungalow could sometimes be a little chaotic. But it’s a happy home — or it was — and Stewart and Fiona were happy there.

Nine months after Stewart’s birth it became apparent that their mother was in no state to bring up a child (Stewart’s father had already committed suicide).

So her parents brought Stewart up as their own. When Fiona, who has never even met her own father, was born a year later, they took care of her, too.

‘We thought it was our duty as grandparents,’ said their grandmother. Duty has become a forgotten word in Britain today, and one, it seems, on which Edinburgh social services places little value.

Initially, social services appeared concerned to ensure only that the children avoided contact with their unstable mother. But gradually the emphasis changed.

The children, they suggested, should be taken into foster care, while maintaining regular contact with their grandparents. After much soulsearching, the couple agreed.

It was, after all, only temporary. But that was two years ago. The grandparents have no criticism of the foster parents. But Stewart and Fiona missed their own home terribly.

Stewart would ask his foster mother: ‘When am I going to see my granny and grandad again?’

She would put calendars in their bedroom with stars marking the dates when they would spend the weekend at their old home; strangely, there is no mention of this on Stewart’s Having Your Say report.

The weekend visits happened once a month — until social workers began to press for them to be less frequent.

Gradually, the department’s true intentions emerged. They did not believe the grandparents should look after Stewart and Fiona at all. They thought the children should be adopted.

From what the grandparents could establish, social workers were concerned about their age and health. True, the grandfather has angina and has suffered a heart attack.

But that was in 1998 when he was working up to 18hours a day on a farm. He was signed off work a year ago and now leads a normal life.

The grandmother is 46 and has diabetes. But as she points out: ‘How am I able to look after my two youngest children?’.

She is an active mother, who regularly took Stewart and Fiona swimming and bowling. Last year, she even went skiing.

She revealed: ‘At one stage they told me it was selfish wanting to look after the children. How can it be selfish to want to look after your own family?’

The couple have records from four court hearings which show that two sheriffs — the Scottish equivalent of magistrates — heard the case at different times over 18 months and were sympathetic. The sheriffs refused to remove their parental rights.

Yet eventually, the pressure from social services became overwhelming, and the couple were assured that if they gave up their parental rights, they would still have regular contact and would be involved and informed in all aspects of the children’s lives.

In August, they gave up the fight. In a letter to Edinburgh Sheriff Court, the grandfather wrote: ‘These are the reasons for making this choice, which I might say has been very difficult for us.

‘We feel that due to the time involved in this process and the various objections raised by the social work department it would be in the best interests of the children that we gracefully back out of the proceedings and give up all rights to our grandchildren.

‘I must admit that I feel bitter about the whole situation, as they [the social work department] are determined to have them adopted, regardless of our feelings.

‘We have tried very hard and have co-operated with them in every way possible. Both my wife and myself love Stewart and Fiona to bits, there is nothing we wouldn’t have done for them.’

The following month, the children’s mother said goodbye to them during a trip to Edinburgh Zoo. A few weeks later, their grandparents handed them over to Heather Rush at the Oxgangs office.

Stewart wanted a toy lawnmower as a farewell present; Fiona a bubble-making machine.

Stewart and Fiona have had several meetings with the men who are soon to become their full-time fathers. They are understood to be seeing them for a few hours daily and have visited their home.

But will their grandparents ever see the children again? ‘When they get older and ask why, we will have the necessary paperwork to prove that we both fought for them and the reasons it was not to be,’ said their grandfather.

Several years ago when my then 5-year-old was attending first grade at a local state school, he came home with a document called a “Social Justice Policy”. I was supposed to read it and pass on any comments. Most parents probably would not have read it. I did, and I was upset by what I read. The document was basically a feminist tract which proposed a number of measures to make every aspect of the school more “gender inclusive”.

I sent off a three page letter asking such questions as: “Do you intend to force boys to play with dolls and girls to play with tanks to achieve your goals? “Will you rid your library shelves of the Bible, Charlottes Web and Thomas the Tank Engine and other “sexist” books to make them gender inclusive?

I knew that attempts to enforce political correctness and to engage in social engineering were rife in colleges, but I was not prepared for seeing my 5-year-old being used as a tool in this madness.

This was to be my first exposure to an educational system that has long ago abandoned simply teaching knowledge and skills, but instead acts as a change agent to redirect our children’s values and beliefs. As Phyllis Schlafly describes it, our schools have replaced “cognitive education (which addresses the child’s intellect, and teaches knowledge and skills) with affective education (which addresses the child’s feelings and attitudes, and spends classroom time on psychological games and probing personal questionnaires).”

Phyllis Schlafly continues: “In practice, this ‘therapy’ education is a system of changing the child’s values by techniques such as attitude questionnaires which dig into the privacy of the child and his family[journels do this as well] , psychological games in the classroom, and forcing the child to make adult decisions about such matters as suicide and murder, marriage and divorce, abortion and adoption.”

Child Abuse in the Classroom is about the psychological, emotional, moral and intellectual abuse children experience while enduring such programs as “values clarification”, “behaviour modification” and “Outcome-Based Education”. This book contains over one hundred testimonies by concerned, outraged and angry parents about what their children have been getting in school. These are selected transcripts of 1,300 pages of testimony given at U.S. Department of Education hearings. They make clear that children may not be getting much of the Three R’s in school, but they are getting plenty of “therapy education” which is often anti-family, anti-morality and anti-religion.

The stories make for gruesome reading. For example, one mother told of a questionnaire her twelve year old daughter had to fill out for her health class. She was required to answer many personal questions on her views of life and death. She was asked: “What reasons would motivate you to commit suicide? ” Also, “she was given a list of ten ways of dying, including violent death, and asked to list them in order of ‘most to least preferred’.”

One parent told of how his junior high school student had to sit in a group of five or six, to think up as many synonyms as they could for words such as penis, vagina, intercourse and breast. Then they were to rearrange in couples and engage in a conversation for three minutes using as many of the words as possible.

Another parent spoke of a class his 7th grader attended in which he had to get in a group and assess the following scenarios: “Swimming in the nude at a private beach with a friend; not telling your parents the truth as to where you are going and what you are doing; having sexual intercourse with your boy or girlfriend; cheating on an exam”.

A number of distraught parents described the “Magic Circle” in which first graders sit in a circle, and volunteer information about their home life or anything that bothered them. Children were told it was OK to lie and rebel against parents, and that religion was so much nonsense. And the students were told not to tell their parents about the circle.

One mother told of how her elementary school children had to take part in “education socio-dramas”. In one drama dealing with “quality of life” issues, eleven students are told to act out being “in a bomb shelter with provisions sufficient to last eleven people for two weeks or six persons for a month. The group is to decide which five are to be killed. Students are instructed to accept the situation as fact.”

Another parent complained of the literature available in his son’s school: “Many of the teaching materials are close to being pornographic, if not actually pornographic. I don’t know if you are familiar with the book, Show Me, which is in many school libraries. This book cannot be sold in a porno shop in Colorado because it would violate the child pornography laws, but it can be put in our public schools and libraries.”

One class for elementary school children has a session on lying, and asks the children what they think about lying. They are told to finish the following sentence: “I would lie if….”.

A mother spoke of a junior high girl who was subjected to an ordeal “in which she was required to defend her religion and values under extreme ridicule from the group leader and from her peers.”

Sex education courses were filled with pornographic and immoral material. Many of the textbooks for young children featured explicit information on masturbation, homosexuality, oral and anal sex. More than one parent was told by school principals that if they didn’t like what was being used in the classroom, they should leave the school system.

This book is filled with these kinds of horror stories. It should be clear that we need to be aware of what our children are getting dished up in the schools. Indeed, we need to become much more involved in our children’s education. Many parents would have no idea what their children are being taught, not just in sex education classes or other controversial areas, but in the core curriculum as well. But they should be aware.

Here in Australia for example, the Victorian Association for the Teachers of English at a recent conference discussed ways of “developing positive awareness of homosexual issues in the classroom”. And the Australian Education Union argues for the “rights of all teachers to influence curricula in ways that will enhance understanding and acceptance of lesbians, bisexuals and gay men”.

Such examples could be multiplied at length. It’s scary stuff. But this book does more than warn us. It also features a helpful section on how parents can evaluate their school programs. These guidelines will help parents who want to assess the information and education their children are getting. And such an assessment is absolutely crucial, given that much that passes for education today is really indoctrination.

Indeed, the classroom has become a battleground for the hearts and minds of our young people. Yet most parents are asleep at the wheel. We are losing our children , and it is largely our own fault. All concerned parents should get involved in what our children are getting at school. And one way of taking a stand is to get this book and become informed.

In the cases of Rusty and Jessica, [below] however, no one activated an Amber Alert. There was no news media blitz.

Why?

Because these children were but two of the thousands forcibly separated from their families each year by the Child Protective Services (CPS) system.

Help Becomes Betrayal

Child Protective Services, in the eyes of many parents and advocacy groups, is a cruel misnomer.

One prominent children's rights advocate whose efforts were instrumental in bringing about the legislation that created the CPS system in the 1970s is Walter Mondale, former vice president and senator. Subsequently, Mondale reportedly feared that the Child Abuse Prevention and Treatment Act he introduced in the Senate in 1974 "could lead to systemic abuse in that the state agencies might overprocess children into the system unnecessarily to keep, and increase, the flow of federal dollars." (1)

That, the record shows, is exactly what has happened, with critics today comparing the system to Dr. Frankenstein's monster — out of control, destroying children and parents alike.

But how did this transformation of a system originally intended to help children come about? Freedom's (magazine) investigation found the psychiatric industry to be at the core of this perversion, as documented in this report.

As early as 1977, a formative year for the CPS system, psychiatrist Bertram S. Brown, then director of the National Institute of Mental Health (NIMH), revealed the self-appointed mission of his profession to gain control of this territory. "The tough role — that of change agentry vis a vis the family — has devolved upon the mental health system," he wrote in the foreword to a 200-page NIMH publication, Child Abuse and Neglect Programs: Practice and Theory.

Subsequently, over the decades, psychiatry's role in bringing about such change has burgeoned — including the vesting of more and more public funds in wasteful and destructive psychiatric drugs and other "solutions." At the same time, psychiatric control of the child-protection system has been detrimental to the system's stated goal of keeping families together, with Rusty and Jessica being but two of an untold number of tragedies.

In interviews with Freedom, mothers described the serious abuse of their children under Child Protective Services programs.

A Mind-Altering Potpourri

In 1995, after her daughter Jessica, then 5, was molested, Audrey Serrano turned to the Massachusetts Department of Social Services for help. [NEVER - NEVER -NEVER go to Children services for help! ]

Referred to psychiatrists, including Elliott Pittel at the Herbert Lipton Community Mental Health Center in Leominster, young Jessica was, by age 6, placed on a potpourri of mind-altering pharmaceuticals while still living at home. These included an amphetamine-type drug and three different antidepressants. All three antidepressants prescribed to Jessica are among the drugs that have recently been the subject of multiple warnings from health authorities in numerous nations, including the U.S. Food and Drug Administration (FDA). Their labels bear the FDA's most serious "black box" admonition — that they will "increase the risk of suicidal thinking and behavior." The FDA indicated that the manufacturer of the amphetamine-type drug Jessica had been prescribed would be forced to alter the drug's label to reflect problems "such as visual hallucinations, suicidal ideation, psychotic behavior, as well as aggression or violent behavior."

By 1998, when Jessica was 8, other powerful drugs had been added to her daily regimen, including two powerful amphetamines.

While on these potent drugs, Jessica began to hear voices, a side effect of amphetamine usage. The voices told Jessica, in her mother's words, "to do bad things, to kill people." They also warned that someone was coming to kill her, so Jessica began to sleep with knives under her pillow and under the bed for protection. She talked openly about wanting to kill herself, a side effect of her antidepressants.

She banged her head against walls, dug at her skin with her fingernails, and began to be cruel to animals — tying one cat up in a bag and stuffing another into a toilet.

This array of bizarre behavior bewildered her mother. "This never happened before the drugs," Serrano said. "They Would Slam Her to the Floor"

Serrano became so concerned about escalating medication and worsening problems that she gradually weaned Jessica, then nearly 9, off the drugs. Jessica stopped hearing voices. Her behavior improved. She no longer thought about killing herself. "I feel much better," Jessica told Pittel during an office visit. "My head doesn't hurt anymore."

Elliott Pittel berated Serrano, however, insisting that Jessica go back on psychiatric drugs. "I'm a doctor and I know what's best," he reportedly said. "You don't have a degree."

When Serrano informed Pittel of the many adverse effects Jessica had suffered on the drugs, the psychiatrist, in Serrano's words, got "beet-red" and "highly upset." "He told me that I had to put her back on them or he would file a 51A* for medical neglect," Serrano said, an action that would bring about loss of her daughter to the CPS system. "So I put her back on."

Not long after the meeting with Pittel, Jessica was abducted anyway — taken directly from school by CPS personnel, who claimed Serrano was unfit to be a mother because she had tested positive for HIV — a test later shown to be false.

Almost unbelievably, with Jessica held in the CPS system at Hillcrest Education Center in Lennox, Massachusetts, psychiatrist Theodore Lindauer recommended still additional drugs, including up to 500 milligrams daily of Thorazine, described by the man who pioneered its use as a "pharmacological substitute for lobotomy." (See "The Littlest Guinea Pigs".)

Separated from her mother for a span of 23 months between the ages of 9 and 11, Jessica ultimately endured six foster homes and a residential care center. At two homes, she allegedly was molested. Powerful, mind-ravaging drugs were injected against her will. According to information presented to Freedom by Serrano, Thorazine was given without court order or parental permission, as required by law. COERCIVE DRUGGING

TAKING IT TO THE COURTS:

After daughter Jessica was given such dangerous drugs as Thorazine and brutalized within the system, Audrey Serrano (center, with Jessica and attorney Gregory A. Hession) filed suit.

In Massachusetts, before anyone can be administered a neuroleptic ("nerve-seizing") drug against their will, a hearing to authorize it must be held before a judge. According to Audrey Serrano, and her attorney, Gregory A. Hession, no such hearing took place before the neuroleptic drug Zyprexa was administered to Serrano's daughter, Jessica (inset, at age 6), while in Massachusetts Department of Social Services' custody. Psychiatrist Theodore Lindauer authorized giving Jessica up to 500 milligrams daily of one neuroleptic, Thorazine, and doses of two others as well. In an interview with Freedom, Lindauer described the Thorazine dosage as "ridiculous." After Freedom obtained documentation of Jessica's "treatment plan" in which Lindauer prescribed the life-threatening regimen for the young girl (right), he refused to answer additional questions. As early as age 6, while under "treatment" at the Herbert Lipton Community Mental Health Center in Leominster by psychiatrist Elliott Pittel and others, Jessica was subjected to drugs that, according to recent government warnings, can trigger violent and suicidal behavior, or sudden death.

"All she had to do was say 'no' to them and they would slam her to the floor; someone would place a knee in her back and tie her hands," Serrano said. "There was so much emotional damage I can't even begin to tell you." Jessica's little body bore bruises from forcible injections, she said.

Far from "helping," these drugs created her daughter's severe problems, according to Serrano. She finally got Jessica back, but scars from the ordeal remain. To help inform others of her experiences, Serrano formed an organization, Families Against Abuse, which today has a nationwide membership (http://www.familiesagainstabuse.org/).

Death of a Patient

When telephoned by Freedom, psychiatrist Pittel refused to answer questions. His colleague, Theodore Lindauer, denied that he had recommended 500 milligrams daily of Thorazine, calling that high a dosage "ridiculous." But after Freedom obtained documentation of Jessica's "Treatment Plan" in which Lindauer authorized up to 500 milligrams daily of Thorazine, he declined to answer additional questions.

In the course of its probe, Freedom learned that Lindauer was disciplined in January 2004 by the New Hampshire State Board of Medicine, following the 1998 death of a patient at a New Hampshire facility at which Lindauer then served as medical director.

According to information received from the board, the man had been admitted to Beech Hill Hospital in Dublin, New Hampshire, with a substance abuse problem. Due to the seriousness of his condition, he was to be monitored every 30 minutes. During a periodic check, the man was found to be "unresponsive." Rushed to another hospital, he was pronounced dead.

Dori Todd Hill of the Board of Medicine told Freedom that Lindauer "was responsible for making sure that the hospital was equipped to handle these emergencies and that patients were properly monitored." In its published findings, the Board of Medicine stated, "Dr. Lindauer is reprimanded and his license to practice in the area of substance abuse is restricted until he has completed 80 hours of continuing medical education in the assessment and treatment of substance abuse."

More trouble looms for Lindauer, as Audrey Serrano told Freedom she intends to add him as a party in the lawsuit she has pending against the Massachusetts Department of Social Services, Hillcrest and others.

The Child Protective Services system has become an object of psychiatric industry greed, say experts who track, expose and seek to eliminate this brand of child abuse. A "gangster racket" : that's how New York author and psychologist Seth Farber, Ph.D., describes Child Protective Services. "It's a corrupt system," he says, "with psychiatrists and their behavioral classifications at the heart of it."

Outraged by the high doses and multiple prescriptions of psychiatric drugs rampant throughout the CPS system, physicians like Ben Raimer and legislators like Arizona House of Representatives Judiciary Committee Chairman Eddie Farnsworth are speaking out to help curb the abuses.

More Foster Children, More Profit

As established by federal law, every state has an agency to combat child abuse. Usually located within the state's Social Services department and commonly called Child Protective Services, the network comprises an expanding, multibillion-dollar empire, with offices in every county — and with each child representing tens of thousands of taxpayer-funded dollars per year funneled to the psychiatric machine controlling the child's fate.

A major source of CPS revenue, nearly $5 billion a year, comes from the federal government through Social Security, under a provision allowing open-ended* funding. By the nature of such a system, the more children placed in foster care, the more money a state gets, producing a psychiatrically centered system that, instead of working to keep families together, strives to capture more and more kids, and to put more and more of them on drugs.

As the California Child Welfare Services (CWS) Stakeholders Group, an organization under the state Department of Social Services, explained: "The federal system of funding child welfare services at the state and county levels creates a 'perverse incentive factor' by providing open-ended funding for children and youth who are in the CWS system vs. providing capped funds for prevention and early intervention efforts.

"This 'perverse incentive factor' results in the state and counties earning the most revenue by having more children in the system as opposed to their receiving the funding necessary to reduce the need for Child Protective Services in the first place." (2)

Audrey Serrano noted the incentives include bonuses for CPS employees who bring children into the system — with quotas issued to make sure they do so. New York author and psychologist Seth Farber, Ph.D., told Freedom that such abuses make him consider the CPS system a "gangster racket," with psychiatrists and psychologists at its core.

"They take children away from their mothers and bounce them around in the system," Farber explained. "It's a corrupt system, with psychiatrists and their behavioral classifications at the heart of it."

Falsely Labeling Innocent, Normal Kids

In New York, Farber said, psychiatrists and psychologists appointed by the courts to evaluate children or parents are paid at least $500 an hour. These "evaluations" all too often result in the separation of parents and children — particularly, Farber said, when there is a single mother and she happens to be African-American.

Nearly all of the victims of the CPS system in New York, he said, are poor black women.

Once a child has been removed from the family, frequently on the nebulous charge of "neglect," the systematic milking of funding streams begins. Sources include Medicaid, the Crime Victims Compensation Fund, Social Security Disability Insurance and others.

Some states automatically issue Medicaid cards to children removed from their homes, making it easier to tap into federal funds.

One social worker informed Freedom that once a child receives a psychiatric label, his or her foster home immediately becomes eligible for roughly double the amount of money for that child.

Speaking on condition of anonymity, this source noted that the system has become geared toward giving children psychiatric labels and drugs because such "treatment" brings far greater income to foster parents and those administering group homes. "It's a dishonest system that falsely labels innocent, normal kids on a wholesale basis, condemning them to a life with a phony psychiatric diagnosis," she said.

The WAR on Families Rafe ABUSE WITHIN THE SYSTEM Taken from his mother for "abuse" she bitterly denies, young Rafe reportedly suffered three head injuries and cuts on his leg during one week in CPS custody.

A review of state child welfare hand-books reveals that, empowered by psychiatrists, Child Protective Services (CPS) agents wield the power to label any parent "unfit" and to take away his or her children.

Based on these guides, genuine objectivity becomes difficult to impossible, leading to injustice even in the hands of well-intentioned employees. New York's manual, for example, contains a chart regarding physical and behavioral signs of abuse or neglect. It includes any type of physical injury, even though contact sports, bicycle or skateboard accidents, and so forth, could be actual causes of injury. This chart contains such catch-all terms as aggressiveness, withdrawal, low self-esteem, failure to thrive, speech disorders and fatigue. [These are all behaviors that a child suddenly taken from their family might normally show]

Colorado's points for determining "abuse" and "neglect" include eating disorders, bed-wetting, early arrival or late departure from school, poor communication and PR skills, inappropriate height or weight, and parents unsupportive of school personnel or disdainful of public schools/teachers. According to this, a child who happens to be shorter and skinnier or, perhaps, taller and heavier than average and who shows up to school early may well be in need of state intervention.

According to author and foster mother Mary Callahan, birth parents are up against a stacked deck when they deal with the CPS system. "They tell the parents if they go and get a parent capacity evaluation, this will help them get their children back," she told Freedom. However, she said, "95 percent of the parents that they see end up with a psychiatric diagnosis."

Callahan said that when she challenged a doctor who enjoyed a lucrative contract with the Maine Department of Human Services to give such evaluations, he winked at her and said, "They send them to me for a reason."

Money and Dangerous Drugs Drive the System

Documents obtained through Freedom of Information Act requests filed by the Citizens Commission on Human Rights (CCHR*) in Massachusetts revealed that an incredible 64 percent of the children in the custody of the Massachusetts Department of Social Services (DSS) had been labeled with at least one "mental illness." Virtually all those so diagnosed are typically placed on one or more drugs with serious and even deadly side effects.

Chris Garrison, director of CCHR Massachusetts, said, "These documents and reports from whistleblowers and parents of children taken away by Social Services make it evident that DSS and its mental health vendors are using children like Jessica as a commodity by billing for lethal drugs and needless, harmful psychiatric procedures."

Not the least of psychiatric evils is the sanctioning of forced abduction and the drugging of children. Experts note that such labels as "Separation Anxiety Disorder," "Adjustment Disorder" or "Mood Disorder" could well describe normal responses to an abrupt, enforced removal from the child's home and family and into the clutches of a cold and abusive system. These tags are then employed to force children to take powerful drugs.

At a hearing of the Human Services Committee of the Texas House of Representatives in October 2004, Ben Raimer, M.D., a pediatrician, testified that he had seen children in foster homes on "as many as 11 psychotropic meds."

Raimer described visiting one foster home where four children, aged 2, 3, 5 and 6, were all on large numbers of drugs, with heavy doses of each. "The more the medications or diagnoses that a child is on, the more the reimbursement per child is for a foster parent," Raimer explained.

The drugs pouring into the nation's foster children come at a high price. As Arizona State Representative Eddie Farnsworth told Freedom, "The heavy reliance on psychiatric drugs has had a very negative effect on the children in our society across the board." The omnipresent ADHD label, he said, has created an epidemic of child drugging across all facets of society.

Psychologists and many people who are not medical doctors have labeled countless children with so-called mental disorders to promote the psychiatry-controlled CPS money machine.

Neurologist Fred Baughman, M.D., told Freedom, "There have been amazing stories of diagnoses made in schools of ADHD, 'conduct disorder' and 'oppositional defiant disorder.' Then the schools turn to CPS to coerce the parents or take them to court to enforce the treatment of these things as though they were actual diseases, which they are not." The "treatment," he said, comes in the form of dangerous and sometimes fatal drugs.

Money is the Driving Force
Children from the foster care system — dominated by psychiatry and its drugs — tend to do worse in life than those raised by their own parents or families, with study after study confirming that Child Protective Services (CPS) failed those it claimed to help.

Statistics on educational performance, drug abuse, crime and homelessness reveal how the system has been crippled by psychiatric influences.

A research team, for example, conducted an evaluation of 749 17-year-olds leaving the foster care system in Iowa, Illinois and Wisconsin. Their report, issued in 2004 by the University of Chicago's Chapin Hall Center for Children, showed "nearly two-thirds of the male and half the female foster children had been arrested, convicted of a crime, or sent to a correctional facility." Over half of these 17-year-olds were not yet reading at seventh-grade level. (1)

The Urban Institute found that children aged 12 to 17 in the child welfare system had been suspended or expelled from school in 32 percent of the cases, compared to 13 percent in parental care. (2)

A U.S. Senate measure from 2003, the Improving Education for Homeless and Foster Children with Disabilities Act, included alarming statistics: "In a number of states, more than 60 percent of children and youth in foster care drop out of school before graduation; a rate that is twice as high as the dropout rate for all students."

A 2002 study by Child Trends, a research center in Washington, D.C., found that only 48 percent of all former foster youths had graduated from high school, 3 compared to 71 percent that year for all public school students.4 A 1996 University of Wisconsin study found that one-third of those exiting foster care became homeless,5 compared to less than one percent in the general population.

"Money is a driving force" in the CPS system, author Mary Callahan told Freedom. More money is given by the state for ever more psychiatric diagnoses and ever-increasing amounts of psychiatric drugs.

"If money only flows if kids get worse, somehow, they just keep getting worse," Callahan said. The heart of the matter, she noted, is to change the system so success, not further failure, is rewarded.

FAILING GRADES FOR FOSTER CARE

A 2005 study* by the University of Chicago's Chapin Hall Center for Children found that 37.1 percent of those from foster care failed to get a high school diploma or general equivalency diploma, compared with only 9.4 percent of other Americans their age. This study, the most extensive of its kind in decades, also documented how those caught in the foster care system encounter higher rates of unemployment, homelessness, violence and crime.

Falsely Labeling Parents :
Rusty Roska and his mother, Connie HARD-WON VICTORY

Rusty Roska was forcibly removed from his family's home in 1999 after his mother, Connie, was assigned a psychiatric label that has since been widely discredited. The family fought back and won a landmark legal victory against Utah's Division of Child and Family Services. Regarding the violent separation, Connie (shown with Rusty in 2006) said, "To this day, my daughter cries when she remembers it."

Psychiatric labels are also slapped on parents by psychiatrists and psychologists. Seth Farber explained that one means by which the New York child welfare system obtains more children is "to have their psychologists say the parent has a 'psychosis' or 'personality disorder.' If that parent doesn't want to give up his or her child, or doesn't trust the psychologist on the agency's payroll, that data is used to 'prove' that a 'mental disorder' exists.

"Once that parent has been labeled 'mentally disordered' by a psychologist, child welfare doesn't have to prove the parent actually did anything wrong. In the complete absence of any evidence of parental wrongdoing, that psychiatric label is sufficient justification to seize the child." (See "The War on Families," page 11.)

Farber noted, "You're not going to find a psychologist or psychiatrist say anybody is mentally healthy — except for themselves and their friends and buddies."

Rusty Roska was plagued by serious physical problems, but those problems went undiagnosed and untreated, while Salt Lake City psychologist Eric Yelsa reportedly badgered him with such comments as "We know you're psychotic" and such questions as "You want to kill your family, don't you?"

When Utah's Division of Child and Family Services seized Rusty, it invoked the psychiatric label of Munchausen's Syndrome by Proxy (MSBP), which asserts a parent intentionally made his or her own child sick in order to gain attention.

In affixing the MSBP label, psychiatrists have targeted mothers in particular. Sometimes, as in Rusty's case, doctors encounter medical problems difficult to diagnose or treat; in many cases, psychiatrists have frequently and inaccurately blamed a parent, using the MSBP diagnosis.

Condemnation of this particular trumped-up "disorder" is not limited to the United States. In Australia, Dr. Helen Hayward-Brown, a sociologist, said, "Ordinary mothers and fathers are being accused of child abuse because their children have an illness that some pediatricians cannot diagnose, or the parents strongly question the doctor over the child's treatment.

"The parents are refused the opportunity to obtain a second medical opinion as this is labeled 'doctor shopping,' part of the MSBP child abuse profile — even though doctors are ethically obliged to allow it and it is a patient's right to obtain a second medical opinion."3

In the United Kingdom, Lord Geoffrey Howe, shadow spokesman for health in the House of Lords, blasted MSBP as "one of the most pernicious and ill-founded theories to have gained currency in childcare services over the past 10 to 15 years. It is a theory without science.... It rests instead on the assertions of its inventor (Dr. Roy Meadow).... When challenged to produce his research papers to justify his original findings, the inventor of MSBP stated, if you please, that he had destroyed them."4 (For news on a similar case of destruction of psychiatric research, see "Swedish Drugging Advocate Slapped Down by Courts," page 17.)

Although the MSBP diagnosis has no more scientific validity than the accusation of witchcraft did in its day, mothers such as Connie Roska have lost their children when a psychiatrist or psychologist assigned the label.

According to Roska, after the family sought medical help from the University of California Los Angeles (UCLA), Brenda Bursch, a psychologist at UCLA's Neuropsychiatric Institute, went so far as to accuse her of slaughtering a small animal and putting the blood into Rusty's urine sample.

But after Rusty's abduction, the Roskas utilized the legal system, sued the state, and won — a triumph of justice over phony labeling. (See "Fighting Back," next page.)

After being freed from unwanted psychiatric "assistance" through the action of her parents, Abbey Chaplin (with her fiancé above) is doing well in college, supporting herself and regularly making the dean's list.

I have helped many families get their children back — probably 13 in the last few years, and have made sure their constitutional rights were met," said Connie Roska, whose son, Rusty, was abducted from their home after she was assigned a false psychiatric label.

Roska sued the state of Utah after getting Rusty back. The 10th U.S. Circuit Court of Appeals ruled that, except when immediate danger exists, children could not be removed from their parents without a warrant from the court.

Following the verdict, the Utah legislature incorporated this principle into state law. "If you look at the standards in the law now," said the Roskas' attorney, Steve Russell, "the language is right out of the Roska decision."

Asked why he took on the case in 1999 and pursued it for years with no promise of payment, Russell said, "I have had clients who had been abused by the system and I was looking for a case that is so rock solid that I could really make a difference. I have eight children. I did this for my own family and for everybody else, so they could be free."

The trial judge ruled the case would go to a jury to decide, not whether the Roskas' rights had been violated since that was not in dispute, but how much they should be awarded in damages. On February 9, 2006, the 10th Circuit upheld this ruling. As Freedom went to press, the case was slated for a federal jury trial to determine the amount of damages.

Many besides the Roskas and Steve Russell have fought the system and made a difference. As reported in an earlier issue of Freedom, Butch and Kitral Chaplin faced charges of "medical neglect" for refusing to put their then 14-year-old daughter, Abbey, on a mix of dangerous drugs. Although Abbey was taken from them and locked in a mental institution, the Chaplins fought successfully to get her back and have had all charges against them dropped.

Five years later and free from psychiatric "assistance," Abbey is supporting herself through college and making the dean's list, her father told Freedom.

Butch Chaplin has spoken to other parents threatened with loss of their children. He tells them the only way to win is to stand up for their rights and not to back down. "People say, 'Why is it like that? Why doesn't it change?'" Chaplin said. "Well, this is the absolute truth: it is because good people say and do nothing."

Saving the Family

Big Brother does not make a good parent. The psychiatrist-dominated CPS system, which places labeling and drugs above responsibility and accountability, proves this.

Many decision-makers now realize that government will not love and nurture a child the way a parent will. Hence, some states are changing their programs to emphasize keeping families together. Although these changes may not "maximize federal reimbursements" in the short run, viewed from a larger perspective, such reforms are best for children and families and for society as well.

In Utah, for example, following the Roska family's victory in the courts, the legislature considered nearly 20 bills intended to reform the treatment children received at the hands of CPS and mental health professionals in that state. By the end of the 2004 legislative session, 10 of the measures had been signed into law.

In California, the state with the largest number of foster children, Governor Schwarzenegger made it part of a budgetary plan to change how private foster care contractors get paid. Rather than funding solely on the number of children in the system, payment would be based on positive outcomes.

Shirley Washington of California's Department of Social Services told Freedom the state implemented a measure that "will provide additional foster care funds to help keep children out of high-level care through family-centered, home-based services."

"We need to raise the threshold for taking children from their families to begin with so fewer children get into the system," Gregory Hession said. "Then they won't be drugged and ruined and crushed and killed and raped and murdered and everything else that happens to them. That is the starting point: take fewer kids."

Walter Mondale told Freedom that the original intent of the Child Abuse Prevention and Treatment Act (CAPTA) was to accomplish several objectives to stem child abuse.

"It enacted for the first time federal legislation that recognized the horrors and the persistence of child abuse," he said. "It tried to look at child abuse not just as a law enforcement problem — although sometimes it is — but in the context of troubled families, of the phenomenon of inter-generational repetition of abuse, which was reported to be quite common, and it tried to engage the local governments in reaching out and trying to spot these problems before they worsened."

But today, while many well-intentioned people work in the system CAPTA created, the problem is that the system has been subverted by the psychiatric industry into a revenue-generating entity more important than the children and the families it was formed to serve.

"The abuse my daughter suffered at the hands of psychiatrists tells me that the system would be far better off without them," Audrey Serrano said.

To revamp the system, the first step is to once again prioritize the family and to work to keep families together.

As the former vice president said, "If a family isn't so important, if a husband and wife taking care of kids isn't so important, why is it that every society, all over the world, for nearly a million years has ended up with essentially that system for raising children? Family life is indispensable."

RESEARCH EVIDENCE DESTROYED Swedish Drugging Advocate Slapped Down by Courts CHRISTOPHER GILLBERG CHRISTOPHER GILLBERG and two other psychiatrists were fined for destroying some 100,000 pages of records that may have shown a childhood "disorder" spawned by Gillberg to be based upon questionable or even fraudulent research.

The lack of science to support psychiatry's mental disorders has become the focus of a storm of controversy — particularly so after a series of warnings from the Food and Drug Administration (FDA) about the hazards posed by drugs that psychiatrists use to "treat" those alleged disorders.

Diagnosis is the crux of the matter, and child advocate and author John Breeding, Ph.D., is one of many authorities passionate on the subject.

"It is not just that people are misdiagnosed, but that the psychiatric diagnoses themselves are fraudulent," he told Freedom. "There is no real disease, no physical or chemical abnormality; there is only a subjective observation of behavior they call a disease."

Psychiatrist Christopher Gillberg's recent legal troubles in Europe has only added fuel to the fire.

An international pundit on childhood "disorders," Gillberg has been widely promoted by psychiatric front groups in the United States, such as Children and Adults with Attention-Deficit/Hyperactivity Disorder (CHADD).

Shredding Vital Evidence

When a sociologist and a pediatrician challenged Gillberg to produce his research into "Deficits in Attention, Motor control and Perception (DAMP), which is similar to ADHD, he refused to do so voluntarily. After a Swedish court ordered him to turn over the records, Gillberg appealed and lost.

Rather than surrender the papers, two colleagues and a staff assistant shredded two decades of state-funded research — some 100,000 pages — that formed the basis for Gillberg's plans to put tens of thousands of children on drugs. The perpetrators included Gillberg's wife, psychiatrist Carina Gillberg. On June 27, 2005, Christopher Gillberg was found guilty of official misconduct and fined 37,500 kronor (roughly $4,800), ordered to pay court costs of 75,000 kronor ($9,600) and given a suspended jail sentence. His colleagues were also fined.

Today, scientists and other authorities continue to point out the highly questionable, if not fraudulent, nature of Gillberg's papers, books, doctoral theses and journal articles.

British attorney and physicist Clifford G. Miller, for example, asked, "Where does this place any scientific papers published on the basis of this now non-existent evidence? Papers which were being, it seems, challenged for inconsistencies in litigation? Will these papers now have to be withdrawn by the journals which published them? Will the journals do so voluntarily? How many papers are concerned? In which journals are they published? Will the journals publish any caveat about reliance on the papers concerned?"

"The most rational, albeit very cumbersome, course of action would be to withdraw all research relying on the data," said Sociology Professor Thomas Brante of Lund University in Sweden. "Just like Volvo revokes its cars when a construction fault is discovered, a faulty (or non-existent) scientific diagnosis and its implications must be possible to revoke."

"Virtually All His Research Reports Were Bogus"

Gillberg's American counterpart in "popularizing" speed-type drugs for children, psychologist Stephen Breuning of the University of Pittsburgh Medical School, was convicted in federal court on charges of research fraud.

"Virtually all his research reports were bogus — nearly all the experiments they purported to report had not been conducted; there was no basis for believing that what they 'reported' was true. These specific research reports, moreover, had provoked frightening consequences," wrote author Robert Bell in the book, Impure Science. Bell noted that "the reports had been relied on nationwide in determining drug therapy" for many children and that Breuning had contributed "24 out of the 70 papers published on the subject between 1979 and 1983."1

Breuning was sentenced to five years on probation, ordered to 60 days in a halfway house and 250 hours of community service, and had to repay $77,352 to the federal government. The University of Pittsburgh reimbursed the federal government more than $163,000 it had received for Breuning's research. But, tragically, the use of dangerous drug "solutions" for our children — based to a degree on that same bogus research — only increased.

Breuning's and Gillberg's light sentences send a disturbing message: when it comes to doping our vulnerable children, manipulated and even fraudulent research presents low risks to the perpetrators.

This decades-long charade thus begs the question: Whose interests are forwarded by slanted, pseudo-scientific studies of unproven "behavior disorders," with side effects ignored or minimized?

The pattern is clear: with researchers like Gillberg and Breuning tied to the marketers of dangerous psychiatric drugs, the consumer is getting more fiction than fact.

The American Psychiatric Association changes presidents every year; with characters like these comprising the APA's "elite," it's not hard to see why.

Steven Sharfstein, president of the American Psychiatric Association, puffed with pride on the subject of his appearance on "The Today Show," calling it his "15 minutes of fame."

Unfortunately for him, that exposure produced far more than 15 minutes of acute embarrassment for psychiatry, as questions raised during the show forced him to admit that no test exists for a "chemical imbalance" as the cause of mental disorders. Indeed, in less than 15 seconds, he repudiated the mainstay of modern psychiatric "treatment" with his statement, "We do not have a clean-cut lab test" for such disorders.

The heavily promoted but thoroughly discredited "chemical imbalance" theory underlies psychiatry's high-volume administration of drugs to children and adults — even those given against their will.

As Freedom has learned, Sharfstein has no qualms about administering drugs, electro-convulsive shock "therapy" and other treatments that people do not want (or need), calling such "compassionate coercion."

Such an arrogant, uncaring attitude is traditional at the APA. Ewen Cameron (APA president from 1952 to 1953) had men and women alike chased down by burly attendants and dragged back to their beds, kicking and screaming, for more of what he called "depatterning" — drug-induced "deep sleep" for weeks on end, combined with brain-damaging electric shocks. Many of Cameron's victims and surviving relatives have since collected damages for the great suffering caused by his intelligence agency-funded experiments. But, as revealed in this edition, some of his victims may have been children with no parents, no relatives and no one to report them missing, abused or dead. (See "The Dark Mystery of the Duplessis Orphans," page 22.)

Jules Masserman, APA president from 1979 to 1980, sexually abused female patients drugged with sodium amytal he administered under the pretext of helping them to delve into their "subconscious," billing in the thousands for his "services." In her book, You Must Be Dreaming, singer and actress Barbara Noel described being drugged unconscious by Masserman and awakening to find him, naked, on top of her. After she sued, Masserman settled with her in October 1986 for $200,000, with $50,000 more paid to three other female patients who came forward. Yet, in November 1986, at the 11th World Congress for Social Psychiatry in Rio de Janeiro, the organization's president praised Masserman as "the most prominent psychiatrist in the world." In 1987, evidently fearing a probe by an Illinois agency of his misconduct, Masserman surrendered his medical license.

"Run as Fast as You Can"

Today, a Sharfstein contemporary, APA distinguished fellow Harold Koplewicz, promotes himself as "being recognized as one of the nation's premier child and adolescent psychiatrists." Koplewicz, of Bellevue Hospital and New York Uni-versity's School of Medicine, has appeared on national TV, expounding upon what he viewed as the necessity for intervention by Child Protective Services (CPS) if a family declines to drug a child after a psychiatric diagnosis.

In the context of abuses as described in this edition of Freedom, advocacy of coercive acts against children and families is chilling, and one more example of the APA's arrogance and perverse view of individual rights.

One parent with experience in this regard is Patty Weathers. Appearing at the October 2004 Food and Drug Administration (FDA) hearing that directly preceded issuance of an agency order regarding black-box warning labels — the FDA's most severe cautionary note — Weathers testified that her son hallucinated, heard voices, and became violent and psychotic while on an "antidepressant."

Now the head of AbleChild: Parents for Label and Drug Free Education, a nationally recognized nonprofit organization dedicated to the support of children's and parents' rights, Weathers told Freedom that Koplewicz's endorsement of that same drug as "safe and effective" was "beyond irresponsible."

"I would tell all parents never to contact him," she said. If you have kids, she added, don't walk away from him, "Run as fast as you can!"

Unfortunately, all too many of psychiatry's victims — young and old alike — never had that chance.

A jury has awarded $2.5 million in damages to a woman who received HIV treatments for almost nine years before discovering she never actually had the virus that causes AIDS.

In her lawsuit against a doctor who treated her, Audrey Serrano said the powerful combination of drugs she took triggered a string of upsets, including depression, chronic fatigue, loss of weight and appetite and inflammation of the intestine.
After hearing the verdict, Ms Serrano said: "I'm going to finish my school and I am going to continue to help others.
"I am going to find another doctor that will help me."

Ms Serrano's lawyer, David Angueira, said Dr Kwan Lai, who treated his client at the University of Massachusetts Medical Center in Worcester's HIV clinic, repeatedly failed to order definitive tests even after monitoring of Ms Serrano's treatment did not show the presence of HIV in her blood.
"It is one of the clearest cases of misdiagnosis that I have ever seen and it's based in part on a presumption that people who engage in certain types of conduct are more likely to have HIV and AIDS than other people without really listening to the patient," Mr Angueira said after the verdict.
Dr Lai testified last week that Ms Serrano told her she had worked as a prostitute, her partner had AIDS, and that she had suffered three bouts of a type of pneumonia typically associated with those infected by the virus.
Ms Serrano denied she had ever been a prostitute.
She confirmed that her former boyfriend tested positive for HIV/AIDS, but disputed the claim that she told the doctor that she had suffered bouts of Pneumocystis pneumonia.
Dr Lai's laywer, Joannie Gulliford Hoban, did not return a call for comment yesterday.
Dr Lai testified that she had no reason to question her patient's original diagnosis at another clinic because Ms Serrano convinced her she had HIV when she took her personal history, and her blood had abnormal amounts of cells used to fight infections.
Ms Hoban argued during the trial that Dr Lai had provided standard care to Ms Serrano.
"Audrey's case clearly demonstrates how inadequate that procedure was," Mr Angueira said.
He said his client "is responsible for changing thousands of lives in the future."
The jury reached its verdict after two days of deliberations, Ms Serrano's attorney said.
He said the damages could total about $3.7 million including prejudgment interest.
Ms Serrano filed the lawsuit in 2003 after she became suspicious of her diagnosis and had herself tested at another hospital.

Court rules against child caseworkers:

Lawsuit: A boy, then 12, was removed from his parents; a judge says the workers may be liable

Utah child welfare caseworkers violated state law when they removed a 12-year-old Davis County boy from his home in 1999 - and the workers can be held personally liable, a federal appeals court has said in an unusual ruling.

Caseworkers should have offered services to Connie and James Roska "to prevent removal" of their son Rusty, wrote Judge Michael R. Murphy of the 10th U.S. Circuit Court of Appeals in Denver.

Neglecting to do so, especially after the boy's doctor warned removal would be harmful, constitutes a violation of Utah law, which presumes it is in the best interest of a child to be raised in the care of his parents, Murphy wrote.

The Thursday ruling is the latest twist in a nearly seven-year legal battle, and frees the Roskas to seek damages before a jury.

"We're close to the end now. I want my time in court," said Connie Roska, vowing Friday to pursue her lawsuit against the Utah Division of Child and Family Services caseworkers: Melinda Sneddon, Shirley Morrison and Colleen Lasater. Morrison no longer works for the division.

The lawsuit seeks $15 million in punitive damages. Roska said the money would help pay mounting legal bills, but her main desire is to prevent other families from going through "the same turmoil."

"I can't tell you how horrible it is when a sick son gets ripped out of your arms and you get accused of being the one who is making him sick," she said.

Roska's lawyer, Steven Russell, said any award of damages would be "groundbreaking," because "we're asking them to decide what's it worth when the state comes in and takes your child."

But first, child welfare officials may ask for a review by the full 10th Circuit bench. Friday's ruling was crafted by three judges and contained a lengthy dissent by Judge Terrence L. O Brien.

The Roska suit centers on the May 28, 1999, removal of Rusty Roska from his Layton home.

Social workers and school officials believed the boy was a victim of Munchausen's Syndrome by Proxy, a condition in which a parent acts as if a child is ill, or even causes the child's illness to get attention from doctors. Rusty had lost 70 pounds in a year, was in a wheelchair and had been fed through a tube. School officials expressed concern that he might die if the state did not intervene.

The Roskas said their son suffers from chronic pain syndrome caused by problems with his gallbladder and kidneys. But doctors interviewed by caseworkers could not diagnose the boy's ailment.

The caseworkers tried but were unable to reach Rusty's primary care provider, Judith Gooch. But on the day of the removal, Gooch warned caseworkers by phone that removing the boy would "destroy this family emotionally and Rusty may never recover."

Nevertheless, two workers took Rusty into protective care. He was returned to his family after a hearing one week later.

Rusty is now 19, living in the same home with his parents and working in retail.

"I just wanted to roll over and die that day," he said recalling the day he was removed. "I thought I would never see my parents again."

The Roskas sued, alleging that caseworkers failed to get a warrant and failed to use less intrusive methods as required by law. The suit was thrown out by U.S. District Judge Dee Benson in 2002, but it has since bounced back and forth on appeals.

In its latest appeal, the state argued the caseworkers are entitled to immunity against the Roskas's; lawsuit because state law permitted removals without a warrant.

But Murphy, one of the Utah judges on the court, said caseworkers "failed to actually comply" with the law, which directs them to make "reasonable efforts" to offer services first.

In a dissenting opinion, O Brien argued emergency removal was warranted because Munchausen's by Proxy "is one of the more dangerous forms of abuse" with "substantial risk of mortality."

But the majority opinion countered that three investigations by child protective workers and doctors at Primary Children's Medical Center and the University of California, Los Angeles failed to prove that Connie Roska suffered from the syndrome.

It is not immediately clear how the ruling will affect DCFS practices. Utah law has since been amended, and now there must be an emergency before caseworkers can move in without a warrant.

Also uncertain is whether the state will indemnify the caseworkers and pay damages. "We need to read the lawsuit and . . . talk to the attorneys," said DCFS spokeswoman Carol Sisco.

Dominated by the mental health industry, the child welfare system is rife with abuses, including forcible, unwarranted family separations(below). Many are brutalized, like this boy above, who was injured, according to his mother, after he was taken from her.

Fox News has been caught flashing up a subliminal image of presidential candidate John McCain during its TV intro sequence in what appears to be a deliberate, criminal, and underhanded propaganda ploy.

Blink and you'll miss it, but the image of a smiling John McCain and his wife Cindy is sure to register in your subconscious as it flashes up behind the logo of Fox 5 News, a Fox News affiliate.

Neo-Cons are obviously denying reality again by claiming the image is accidental, but this isn't a "bleed image" from a roll of Kodak, it's state of the art digital editing. It is impossible for an image to be placed there unless its done deliberately.

"I think you people are getting ahead of yourselves," claims one debunker, "the fox guy working the computer prolly just got lazy and used a clip from a previous show, calm down. There are such things as lazy people."

If he merely used a clip from a previous show then why on earth does the McCain image flash up for only a matter of milliseconds? If the image was inserted for a genuine reason then why would it appear for less time than the conscious mind could register it?

The story following the intro is not about John McCain, so that excuse is out of the window too. Again -- the image flashes up too quickly to be recognized consciously.

The fact that Fox News is engaging in this stunt may be unsurprising to some, but the most disturbing aspect of using subliminal advertising is that it has been proven successful.

James Vicary's infamous 1957 claim that he could get New Jersey movie-goers to buy more popcorn and drink coca-cola by flashing the words "Drink Coca-Cola" and "Hungry? Eat popcorn" for 1/3000 of a second at five-second intervals during a film is the subject of much controversy. Vicary asserted that sales of popcorn and Coke in that New Jersey theater increased 57.8 percent and 18.1 percent respectively, but the accuracy of the results has long been disputed.

However, a 2006 New Scientist investigation concluded that "Researchers have shown that if the conditions are right, subliminal advertising to promote a brand can be made to work."

23-millisecond subliminal messages for "Lipton Ice" resulted in 80% of subjects choosing Lipton Ice Tea over other drinks brands in an experiment conducted by Johan Karremans at the University of Nijmegen in the Netherlands.

An investigation needs to be conducted into how the image appeared during the Fox News intro sequence and if a deliberate motivation to engage in mass public deception is found, authorities should consider revoking Fox 5′s broadcast license or at least handing out a gargantuan fine.

The use of subliminal advertising in the UK, Australia and the US is a criminal offence.

It is the mandate of the FCC to clamp down on such an egregious attempt to sway public opinion by means of subliminal psychological influence, especially when the brand being pushed is not merely a soft drink, but a presidential candidate.

"Honorable Lawmakers, Guardians of the United States Constitution and the Federal Treasury, I am a licensed private investigator with more than 54 years experience which includes more than 27 years as a special agent with the FBI. . . As a licensed private investigator...Specifically, in regards to Child Protective Services in some areas and some states, I have been told by a reliable source, that a planeload of children from CPS was flown out of Denver, Colorado on November 6, 1997 to Paris, France. Later a second plane of children also under the care of CPS was flown from Los Angeles to Europe. I have also developed information through credible and reliable sources that in the past, children have been taken from Foster Homes, orphanages, and Boys Town Nebraska, and flown by private jets from Sioux City Iowa to Washington D.C. for sex orgies with politicians.
I have interviewed witnesses who were active in an international child-kidnapping ring, who advised me that, of the thousands of children who disappear every year, many are auctioned off, at various locations throughout the country. This kidnapping ring... One of my sources advised that he has attended six such auctions, with six to thirty six children being auctioned off. These locations are identified as fifty miles outside Las Vegas, Nevada, Toronto Canada, Houston Texas, an unidentified location in Michigan and a barn outside Lincoln Nebraska.
This source informed me that the children range in age from 2-21, both boys and girls. They are usually placed on a stage or platform, in their underwear with a number attached to a string around their necks. The perpetrators bid on the children by number. The location outside Las Vegas was at a small airport. Some of the children were auctioned off to foreigners wearing turbans on their heads. The children were placed in private planes from which they took off. Other children were placed in campers. They were drugged so that if police stopped them the kidnappers could claim their child was sleeping. This same source advised me that when he was ten years old he was used as decoy in public places to attract other children his age to that area, where the adults would grab the kids and flee.
In the early 1990s, following the circulation of "The Franklin Cover-up" for almost a year, the Yorkshire Television of England sent a topnotch investigatory team to produce a documentary on the Franklin Cover Up. They conducted a national investigation for 10 months, interviewing, filming, and documenting the Franklin story, finding new witnesses, and uncovering new evidence. Their documentary, "Conspiracy of Silence" was scheduled to be aired nationwide on the Discovery Channel on May 3, 1994 at 10 PM. When certain members of congress learned that Conspiracy of Silence was to be aired on national TV, the cable industry was threatened with restrictive legislation, the rights to the documentary were purchased by unknown parties and all copies were ordered destroyed. The ITCCS supports the protest being called against Cheney’s appearance for 5:30 pm that day at the Vancouver Club at 915 West Hastings Street, and wishes to inform concerned citizens and the press of these facts:

1. Since the spring of 1994, lawyers and journalists have named the Vancouver Club as a site where children are routinely trafficked, exploited sexually and possibly killed. These crimes were documented, including with photographic proof, by Vancouver trial lawyer Jack Cram and his assistant Renate Andres-Auger, during 1994. Both of these lawyers attempted to bring a lawsuit against two Supreme Court judges in Vancouver for their proven complicity in this alleged pedophile ring, in April of 1994. Both of them were disbarred, and Jack Cram was arrested, drugged and jailed, and the evidence he had on the Club and these judges was stolen.

2. Aboriginal children have been a prime target of the Vancouver Club pedophile ring, which involves senior judges, church lawyers, businessmen and politicians. To quote Jack Cram’s statement in the BC Supreme Court on April 26, 1994, “Indian children go into the Vancouver Club and are never seen again.” As recently as the summer of 2009, aboriginal children have been observed being taken against their will into the rear entrance of the Vancouver Club at 915 West Hastings street from the Squamish Indian reserve in North Vancouver, during the hours of 1 and 3 am.

3. An attempt by reporters with the Vancouver Province and the North Shore News to investigate these claims and the Cram evidence was stopped by a threatened lawsuit against these newspapers from the two Supreme Court judges named by Cram, during 1996 and 1997.

4. One of the predecessors to our ITCCS, the U.N.- affiliated IHRAAM Tribunal into Indian Residential Schools, obtained considerable evidence during its June, 1998 hearings in Vancouver concerning the Vancouver Club pedophile ring. This included eyewitness accounts from an employee at the Club and from a retired RCMP officer, who was discouraged by his superiors from investigating the Club, where the RCMP Superintendent is a member. When one of the IHRAAM investigators, Kevin Annett, publicly surfaced this evidence, he became immediately targeted by a COINTELPRO-type “dirty tricks” campaign by the RCMP and its aboriginal agents that continues to the present day.

4. A United Nations conference on child trafficking, held in Vancouver in September, 1999, confirmed in its summary report that Vancouver is one of three cities in the world where “organized child prostitution and trafficking operates with unofficial police and judicial protection … including at the elite Vancouver Club.”

Considering these facts, we urge protesters to continue their actions against the Vancouver Club even after Dick Cheney has gone, and expose the reason why Cheney is appearing at this center where the proven rape, torture and possible murder of children goes on with impunity – and whether Cheney is himself connected to these crimes.

The ITCCS will be pursuing this investigation and will include its findings in its final report in January, 2012, and will seek an indictment against the Vancouver Club and Dick Cheney in international courts of justice.

"There will be deliberate and incremental changes to Canadian Law... Bill C 36 is dramatic and complex.” (Stephen Owen, Member of Parliament, Vancouver Quadra, November 14, 2001, public meeting in Vancouver, BC, Canada )

Bill C 36 is Canada’s proposed anti-terrorism law. We have to think of the significance of the Owen quote above in the context of globalization. These "terrorism" laws are about the completion of globalization (read corporatization, read fascism), not the elimination of terrorism. Excessive police powers are necessary to quell the expectation of the informed public in western democracies. Citizens expect to be able to access their constitutional rights to protest against the infringement of their rights in the process of globalization.

A police state mindset unhooked the damper in Canada at the APEC meeting of Pacific Ocean governments in 1997 in Vancouver BC Canada, escalated at the Summit of the Americas in Quebec City Canada in April 2001, and again at the G20 meeting in Ottawa in November 2001. Even without Bill C 36 there was the nod by government to the police to violate fundamental constitutional rights to peaceful protest and assembly. Detention of protestors without charges and the use of police dogs against protestors were encouraged.

Since the September 1, 2001 attack in New York city, over 800 people in Canada have disappeared into Canada's detention system without being allowed to contact family or lawyers in violation of human rights. (2). All this before C36 is law.

Justice Minister MacLellan’s proposed changes to Bill C 36 are miniscule and will not prevent police abuse or the destruction of the Rule of Law in Canada. The tiny change to the definition of terrorism fails to eliminate the offensive language of section 27 which catches lawful protestors. Her changes speak to the trickery in government intentions from day one. This is no more than a pretence of response to opposition in effort to fool the public. That we would tolerate human rights abuses even for 5 years is shocking and unsupportable.

Stephen Owen, MP said, “We need the authority of it (Bill C36) in order to implement twelve (12) international treaties that Canada has entered respecting terrorism.” (3). The twelve international treaties Owen talks of referred to in Bill C 36 already have sufficient attention in existing Canadian laws. We do not need the Draconian measures of Bill C 36 to meet Canada's commitments in those United Nations covenants.

What Stephen Owen was saying is that Canadian laws have to be changed because of the globalization agenda, not the needs of Canadians for Canadian interests. A term of the World Trade Organization agreement is that there will be a liberalization and harmonization of domestic laws to accommodate the WTO agenda. Nations are required to suppress citizen unrest over the changes. Bill C 36 is a Draconian measure to prevent citizen interference in that agenda. Its police state powers will terrorize law-abiding citizens.

The 9/11 events in New York are being used to frighten us into accepting the imposition of a punitive inquisitorial system of law in replacement of the Rule of Law.- law that has been developed over centuries since the Magna Carta, the Great Charter of English personal and political liberty, obtained from King John in 1215.

In my view, Bill C36, Bill C 35 (4) and other bills in the works intended to change our law, including dramatic changes to Immigration and refugee law, customs and border protection law, destroy both the rule of law and democracy in Canada. We are destroying the laws that protect Canadians in order to satisfy the dictates of George Bush, the instrument of the New World Order.

On November13, 2001, President Bush declared an "extraordinary emergency" that empowers him to order military trials for suspected international terrorists and their collaborators, bypassing the American criminal justice system, its rules of evidence and its constitutional guarantees. The presidential directive, signed by Bush as commander in chief, applies to non-U.S. citizens arrested in the United States or abroad. The president himself will decide which defendants will be tried by military tribunals. Defence Secretary Donald H. Rumsfeld will appoint each panel and set its rules and procedures, including the level of proof needed for a conviction. There will be no judicial review. (5)

The U.S. Justice Department has asked law enforcement authorities across the USA to pick up and question 5,000 men, most from Middle Eastern countries, who entered the country legally in the last two years. This is part of a sweeping U.S.A. government effort to expand the investigation into Al Qaeda's network and clear the way for the more aggressive prosecution of anyone charged with terrorism. Under the order, the president himself is to determine who is an accused terrorist and therefore subject to trial by the tribunal. The order states that the president may "determine from time to time in writing that there is reason to believe" that an individual is a member of Al Qaeda, has engaged in acts of international terrorism or has "knowingly harbored" a terrorist. The lists of people the U.S. Justice department wants to interview were compiled from Immigration and State Department records of people who entered the U.S.A. since Jan 1,2000, on tourist, student, or business visas. Only men aged 18 to 33 with those visas who are living in the U.S are on the list. (7) (There are about 800 people arrested and detained in Canada as suspects who have been denied access to lawyers and family.) (8)
President Bush is talking of sending suspected terrorists to countries that sanction torture for investigation. U.S.A. media is openly talking about using torture as an investigative technique."The legitimacy of torture as an investigative tool is the latest in a progression of disturbing and horrific topics the news media is now presenting to its audience."(9) Nowhere in international law or in western democracies is torture sanctioned. The highest court in Israel denounced the use of torture in Israel and forbad it. It has come to a sorry state that in the year 2001 such a sick concept as torture is contemplated.

In Canada, our Parliament is preparing new laws on immigration and customs and border protection to harmonize with the US laws. Our sovereign right and entitlement to make laws in our tradition and according to our social ethic is being thrown away by Parliamentarians who know no history nor law, or who are cowards cringing and cowering before a bully, or who are themselves culpable.

What is the Rule of Law?

Margot E Young says there are two unwritten elements of Canada's constitution, two principles that are implicit and essential. They are the Rule of Law and Democracy. (10)

She boils down the rule of law to two simple notions: 1.that individuals be protected from arbitrary power; 2. that all persons- ordinary citizens or members of the government- are equally subject to the law: one law for all. (11)

She sets out the connections of the rule of law in our constitution: (12)
* The Supreme Court of Canada states that the principle of the rule of law is clearly a principle of our constitution and democracy.
* The rule of law lies in the preamble (the interpretive guide) to the Charter of Rights and Freedoms "Whereas Canada is founded on principles that recognize the supremacy of God and the rule of law".
* The preamble to the Constitution Act, 1867 imports into Canadian constitutional structure the principles and postulates of the United Kingdom where the rule of law has long been understood to be the basis of British law.
*The Supreme Court of Canada has held that the rule of law is implicit in the nature of a constitution.

Donald J. Sorochan Q.C. wrote

"The rule of law means that everyone is subject to the ordinary law of the land. This is so regardless of public prominence or governmental status. It requires the law to be applied equally to all, without fear or favour and in an evenhanded manner between government and citizen. It ensures that all are equal before the law. The rule of law is not the law of the ruler. There is no exemption from the ordinary law of the state for agents of government. and no one, no matter how important or powerful , is above the law." (13).

So, ask Canada's Parliamentarians why they (except the NDP caucus) are creating a new law (Bill C 35) that would exclude known state terrorists from the application of Bill C 36, Canada's anti-terrorism law? (14),(15).

There are principles of justice that form the basis of the Rule of Law. These principles have been defined by the Conference on Security and Cooperation in Europe (CSCE) attended by all the European countries, Canada, and the United States in Paris (1989), Copenhagen (1990), and Moscow(1991). (16). Sorochan refers to the broader principles of justice recognized by the conferences. (17).

Bill C 36 violates the following principles:

*Everyone will be presumed innocent until proven guilty according to law. [children can be taken away from parents who have never neglected or abused children. All the state needs to do is to declare that there is a concern that, sometime in the future, children may be abused or neglected]
*Any person arrested or detained on a criminal charge will have the right to be brought promptly before the judge or other officer authorized by law to decide the lawfulness of the arrest or detention.
*Everyone will be entitled to a fair and public trial.
*All persons are equal before the law and are entitled without any discrimination to the equal protection of the law.
*The government and the public authorities have a duty to comply with the constitution and to act in a manner consistent with law.
*Human rights and fundamental freedoms will be guaranteed by law.
*Everyone will have an effective means of redress against administrative decisions.
*Judges will be independent, and the public judiciary will operate impartially.
*The independence of the legal profession will be protected.
*Everyone will have the right to defend himself or herself in court in person or through prompt legal assistance, which will be given free if the person does not have sufficient means to pay for it. *Domestic legislation will comply with international laws relating to human rights, including guarantees for the freedom of information and communication, travel, thought, conscience and religion, right of peaceful assembly, and demonstrations, associations, private property, etc

Antiterrorism bills are being passed in various western former “democracies”, including the US, Britain, Australia, Canada. They do far more that eliminate civil liberties. They eliminate justice. They return to an inquisitorial system of arbitrary arrest and detention (the"disappeared"). Summarized police allegations replace evidence (proof). [family courts allow hearsay "evidence"] The concept of evidence (proof) is gone. Accusation equals guilt. [people can be put on a child abuse list without charge or proof] The concept of innocent until proven guilty is gone. The two essential elements of criminal law to establish guilt, mens rea and actus reus, are gone. (Mens rea is intention to do a crime and actus reus is the fact of doing the crime.) If the state decides a terrorist act was committed and you were in anyway connected or associated, you are guilty whether or not you intended to do the criminal act or whether or not you did the act. The right to remain silent is gone. The principle of confidentiality between lawyer and client is gone (akin to forcing a priest to reveal the contents of the confessional). The concept of a fair trial and the right to a full defence is gone. People or organizations accused of being a terrorist are put on a list. Anyone who associates with listed person or organization can be by association defined as a terrorist. Hence lawyers who defend people accused of being a terrorist face being defined themselves as terrorists. Property and bank accounts can be frozen and confiscated by accusation of being a terrorist. Punishments are excessive and severe (life imprisonment in many cases). These are some of the horrors of Bill C 36.
Rocco Galati said

"... the Muslim and Arab communities will be directly affected. You just have to witness the approximately 800 illegal detentions in this country currently going on in the correctional centres before you even have Bill C-36, where Muslims and Arabs have been directed not to be able to phone their lawyers, see their lawyers, phone their families, see their family as of September 11. That's going on right now. I see it in the jails every day. "

"This bill is, in my humble submission, obscene in the net it casts. You might as well have deleted the constitution from our landscape. This bill is so overbroad, it catches socio-economic and political offences. It creates themstrikes, work stoppages, boycotts, protests, association, assembly, and free speech."

"What's insidious about this bill, if you read section 27 and the definition of what is ‘a prejudicial act to the safety or interest of the state ’, there are various economic crimes in here that relate back to the definition of terrorism which would catch [include], (boycotts for environmental and ethical reasons) would catch [include] any legal strike against the financial markets. This is as much about stomping anti-globalization, anti-poverty, anti-logging protest as it is about terrorism. In fact, if it were just about terrorism, this bill would be 10 to 15 pages long. You are invoking extraordinary measures that we haven't since June 21, 1941 and October 1970 in terms of secret trials, secret trial mechanisms, the abrogation of the right to remain silent, self-incrimination, the 72-hour detention without charge. You have investigative hearings that do away with all charter rights, and then you have seizure of property, and then to charge, convict and sentence someone even without knowledge if he's a facilitator with secret trials."

"I'm probably the only one in the room who's actually conducted these secret trials under the Immigration Act (An existing act without Bill C 36). They are the substance of a dictatorship, of a police state. You don't get to see the evidence, ever. It's all dealt with by the judge, it's covered. The accused person never gets to see it. " .... "The problem with our legislation (Bill C 36) that makes it stand out like a sore thumb is , how do you get an alleged terrorist convicted and how do you have his assets seized? It's in the mechanisms of the 72-hour detention, the investigative hearings, and the secret trials before the trial court that this legislation is unprecedented anywhere in the world. " ... ...it's the way people are arrested without cause or need for a probable cause, and held for 72-hours. They can, in theory, be out the door and back in for another 72, and another 72. There's nothing that stops that. We saw that during the FLQ crisis. Secondly, it's hauling people in for investigative hearings. If you don't answer a question, that's an offence, and you can go to jail, even if they ask you, do you have marijuana at home. There's nothing that protects against self-incrimination of non-terrorist acts in the bill, for instance. Thirdly, when you get to court, and this is unprecedented, the star chamber proceedings that you've mirrored from the immigration terrorist certificates that we've seen for the last twelve years, are unprecedented. They're medieval; they're inquisitorial. I've done them. I, in fact sir, won one in Mr. Jabala's xxx case in 1999. CSIS did not like the result. He has been re-arrested on the same allegations in 2001. You can be re-arrested and re-arrested even if you're acquitted. That is unprecedented anywhere in the world. As you know, Italy had its terrorism nightmare in the seventies. Germany had its terrorism nightmare in the seventies and eighties. " .... ....this, in my humble view and no offence to who drafted it, is a reptilian piece of legislation because it's really conniving in the way it works.”

(Mr Galati illustrates how you have to jump from one part of Bill C 36 to another to follow what it actually does, and to show how tinkering with it will not fix it.) “You have to deal with Section 27 of the bill (of the Official Secrets Act part of the bill ) that amends what is ‘prejudicial to the safety and interest of the state ’, which then feeds in to subparagraph (83.01)(b)(1)(B) because (B) talks about ‘something that in whole or in part with the intention of intimidating the public or a segment of the public with regard to its security,’ and I underline, ‘including its economic security.’

Now, you have to then go to the amendment under Section 27 of the Official Secrets Act, that defines that as a ‘prejudicial safety interest’, and then you have to go to subparagraph (S27)3(1)(d),(f),(j),(k), and (l) and that covers...you can't do anything to adversely affect the financial markets, treaty negotiations for instance, in Quebec City, or APEC.

That amendment to the Official Secrets Act, coupled with ‘economic security interests’, means that political and economic dissent are still acts of terrorism under this law. And I'll read you some of those subparagraphs that are there. If you do anything that ‘adversely affects the stability of the Canadian economy, the financial system or any financial market in Canada without reasonable economic or financial justification’. So the French farmer who wants to boycott McDonalds and maybe dump something with a dump truck is a terrorist under this provision.

Sub (l) (if you do anything that)'’impairs or threatens the capability of the Government of Canada to conduct diplomatic or consular relations or conduct and manage international negotiations.’ So Quebec City, all the protesters would be terrorists and, in fact, RCMP Commissioner Zaccardelli was asked publicly a few weeks ago could he have used Bill C-36 in Quebec City and he said he might probably not, but yes he could have used it to arrest those as terrorists.

So (in answer to a question put by a member of the committee whether deleting section 83.01(E) would resolve the concerns against the Bill) deleting the lawful protest part of (83.01)sub (E) does not do it. You have to go to (b) in 83.011(b)(i)(B) and you have to, unless you delete the amendments to the Official Secrets Act, now (named) the Security of Information Act, you have to delete that reference to ‘economic security’ because then that in turn makes all civil protests for anti-globalization, anti-logging, antipoverty, anti anything that doesn't have an economic or financial justification an act of terrorism and that's why I referred to this as reptilian before because it really is a slivery piece of legislation.

It's not clear in the definition of terrorism (that civil protests are terrorist acts). It's by reference to ‘economic and financial security’ and when you go over to the Official Secrets Act you see that anybody who voices an opinion converse to the government of the day is a terrorist under this (Bill C 36). (18)

The system is already operating as if Bill C 36 was in place. It is using existing law (sufficiently Draconian in its own right) to effect it. Protestors are already being affected. A US citizen social activist, Lisa Fithian, was arrested in Ottawa, Canada November 13,2001 in advance of the G20 economic summit of finance ministers. She was being held by Citizenship and Immigration authorities awaiting deportation. She was in Canada to teach peaceful protest techniques for the G20 economic meetings. She has been in and out of Canada several times during the past year. Grounds for detention include being a flight risk before a deportation hearing can take place, or being deemed a risk to Canadians. (19). (The good news about the G20 economic protests is that simultaneous to the G20 protests in Ottawa, in 60 cities in Europe tens of thousands of protestors were demonstrating against the G20 summit as they were in other parts of Canada.) (20)

Despite the classic crushing process rampant in the commands of the WTO, the World Bank, and the IMF, which process is being institutionalized in these dramatic changes to domestic laws around the western world, protestors are not submitting. The intention of these Draconian laws is to terrorize protestors, drive them into submission, and bend them to the will of the new Iron Heel. These laws are being implemented precisely because of the success of the masses of demonstrators around the world who understand freedom vs oppression. The indoctrination tactic of a Stephen Owen repeatedly trying to frighten the audience and blame Bin Laden and 9/11 as justification to destroy democracy just could not fly before an informed educated audience.

Just as the government of Canada is determined to destroy our democracy ("We will bring in legislation to stop terrorism....Bill C36 is aimed at political, ideological, and religious motivations and perversions that intimidate and move governments," (21), so the citizens of Canada are determined to save it. We are not so weak as Goering said (22).

"Why of course the people don't want war. Why should some poor slob on a farm want to risk his life in a war when the best he can get out of it is to come back to his farm in one piece? Naturally the common people don't want war neither in Russia, nor in England, nor for that matter in Germany. That is understood. But, after all, it is the leaders of the country who determine the policy and it is always a simple matter to drag the people along, whether it is a democracy, or a fascist dictatorship, or a parliament, or a communist dictatorship. Voice or no voice, the people can always be brought to the bidding of the leaders. That is easy. All you have to do is tell them they are being attacked, and denounce the peacemakers for lack of patriotism and exposing the country to danger. It works the same in any country." (23)

Parliamentary Review of the Anti-terrorism Act

The Anti-terrorism Act (ATA) is one of several pieces of legislation that form the Government of Canada's overall anti-terrorism strategy. It takes aim at terrorists and terrorist groups and helps the Government of Canada meet the extraordinary challenges presented by terrorism. The legislation protects the safety, security and fundamental rights of Canadians.

Section 145 of the ATA required a committee or committees of Parliament to conduct a "comprehensive review of the provisions and operation of the Act", within three years from the date that the Act received Royal Assent (December 18, 2001). A motion of the House of Commons on December 9, 2004, authorized the Standing Committee on Justice, Human Rights, Public Safety and Emergency Preparedness to review the ATA. Its Subcommittee on Public Safety and National Security began its review in February 2005. The Senate adopted a similar motion on December 13, 2004, establishing a Special Committee to undertake a separate review.

The House of Commons Subcommittee on Public Safety and National Security and the Special Senate Committee on the Anti-terrorism Act conducted hearings during the 38th Parliament. Transcripts of these hearings can be accessed on the Parliament of Canada website:

The dissolution of the 38th Parliament on November 30, 2005, ended the work of the Parliamentary review committees. On October 23, 2006, the House of Commons Subcommittee on the Review of the Anti-terrorism Act (“House Subcommittee”) released its Review of the Anti-terrorism Act Investigative Hearings and Recognizance with Conditions Program: Interim Report of the Standing Committee on Public Safety and National Security.

The final report of the House Subcommittee – Rights, Limits, Security: A Comprehensive Review of the Anti-terrorism Act And Related Issues – was released on March 27, 2007. The Government filed its response to the Subcommittee’s recommendations, Government Response to the Seventh Report of the Standing Committee on Public Safety and National Security on July 18, 2007.

On February 22, 2007, the Special Senate Committee on the Anti-terrorism Act released its main report (Third Report) entitled Fundamental Justice in Extraordinary Times . On March 28, 2007, the Special Senate Committee issued a supplementary report (Fourth Report). The supplementary report notably commented on the Supreme Court of Canada’s Charkaoui decision and the immigration security certificate process.On October 22, 2007, Bill C-3, An Act to Amend the Immigration and Refugee Protection Act (Certificate and Special Advocate) and to Make a Consequential Amendment to Another Act , was introduced in the House of Commons. The Bill amends the Immigration and Refugee Protection Act (IRPA) to provide a new procedure relating to immigration security certificates and, in particular, to provide for the appointment of a special advocate to represent the interests of a person named in a security certificate. The Bill was introduced after the Supreme Court of Canada ruled in February 2007 that IRPA’s procedure for judicial approval of security certificates infringed the Canadian Charter of Rights and Freedoms and was therefore of no force or effect. The Court suspended its declaration for one year to provide time for Parliament to amend the procedure. The Bill received Royal Assent on February 14, 2008, and was proclaimed into force on February 22, 2008. On October 23, 2007 the Government introduced in the Senate Bill S-3.

Bill S-3 proposes amendments to the Criminal Code that would reinstate anti-terrorism provisions that expired under a sunset clause in March 2007. The proposed provisions are substantially similar to the original provisions, which came into force with the Anti-Terrorism Act in 2001. Bill S-3 proposes:

•provisions to bring individuals who may have information about a terrorism offence before a judge for an investigative hearing,

•and provisions dealing with recognizance with conditions, including preventive arrest to avert a potential terrorist attack.

The Bill also:

•contains a 5-year sunset clause;

•requires that the Attorney General and the Minister of Public Safety and Emergency Preparedness to report annually on their opinion together with reasons as to whether these provisions should be maintained;

•incorporates other technical amendments.

Bill S-3 was passed by the Senate. It was in the House of Commons at Second Reading when the House of Commons recessed on June 20, 2008. The House of Commons is adjourned until September 15, 2008 .

Anti-terrorism Act

In the aftermath of the Sept. 11, 2001 attacks on the U.S., the federal government created Canada's first anti-terrorism legislation defining what terrorism is and making it a punishable offence within Canada's Criminal Code. The Anti-terrorism Act (Bills C-36 and C-42) , was the subject of heated debate and controversy as the Liberal government of the time fast-tracked it through the House of Commons and the Liberal-dominated Senate.

The act became part of the Criminal Code on Dec. 18, 2001. The changes to the code are "aimed at disabling and dismantling the activities of terrorists groups and those who support them."

As it was being drafted politicians and protesters raised concerns that the legislation as proposed trampled on civil liberties because it gave police sweeping new powers, including the ability to arrest people and hold them without charge for up to 72 hours if they are suspected of planning a terrorist act.

The Liberals used their majority to pass a motion to curtail debate, and rejected all of the remaining opposition amendments. The motion passed easily in the House of Commons with a vote of 190 in favour and 47 against.

However, in a nod to civil libertarians, the bill contained a five-year sunset clause on some of its more controversial elements and it is the proposal to extend these provisions that has provoked enormous controversy in Parliament in recent weeks.

The Conservative government has tried to paint the Liberals as hypocritical and weak on terrorism for refusing to extend two provisions in particular. Because both the NDP and the Bloc Québécois are also against an extension, Liberal support is necessary if these elements of the act are to continue. [Remember it was a Liberal government that brought this in to begin with - Now as the opposition, they were oppposing the extension of the sunset clauses]

What's at stake

Of the two clauses that are at the heart of the debate, one allows police to arrest suspects without a warrant and detain them for three days without charges if police believe a terrorist act may be committed.

The other would allow a judge to compel a witness to testify in secret about past associations or perhaps pending acts under penalty of going to jail if the witness doesn't comply.

Neither clause has been used by police or prosecutors in the five years the act has been enforced but, in October, a parliamentary committee recommended extending the two provisions for another five years.

As well, Prime Minister Stephen Harper caused a partisan stir last week when, reading from a news report, he said a relative of a Liberal MP was on a secret list to be questioned by authorities in their reinvestigation of the Air India tragedy and implied this was the reason the Liberals were switching sides.

In the Commons this week, deputy Liberal leader Michael Ignatieff explained his party's change of position, arguing that the curtailment of civil liberties can only be justified under emergency provisions and when public safety absolutely requires it.

"If this is the test," he said, "the clauses should sunset because they have not proven absolutely necessary to public safety. The government, in essence, has not proven its case and on these questions where our liberties are at stake the government has to prove the case of public necessity beyond a shadow of a doubt."

Motive and history

When the bills were passed, the Liberal justice minister at the time, Anne McLellan, said the provisions had three main objectives: To suppress existing terrorist groups, provide police with new investigative tools, and toughen prison sentences for terrorists.
The bills also contained provisions to comply with new UN rules on combating terrorism as well as with similar laws that were being put in place in the U.S. and Britain.

"We believe that people everywhere are entitled to live in peace and security," McLellan said.

Former justice minister Vic Toews

In June 2006, then Conservative justice minister Vic Toews said the government had no plans to toughen the Anti-terrorism Act after the arrest of 17 people in Toronto suspected of planning a bombing campaign. However, he said, it may consider changing the law's definition of terrorism, which is called the motive clause.

This clause defines a terrorist act as one committed "for a political, religious or ideological purpose, objective or cause." Toews said there are two problems with that definition: it could lead to profiling of people of a particular religion, Islam especially, and it could be difficult for prosecutors to provide evidence of a suspect's personal beliefs.

On Oct. 24, 2006, a Superior Court judge struck down the motive clause, saying it violates the Charter of Rights and Freedoms. The judge was working on the case of Mohammed Mormin Khawaja, the first person charged under the new anti-terror provisions.

Khawaja, a software developer, was arrested on March 29, 2004, and faces seven criminal charges alleging that he participated in and gave assistance to an alleged British terrorist organization.

Although the judge struck down part of the law used to arrest Khawaja, he said his trial on the charges could go on.

Highlights of the Anti-terrorism Act:

• It gives the police wide, sweeping powers to act on suspected acts of terrorism.

• It allows suspected terrorists to be detained without charge for up to three days.

• It makes it easier for the police to use electronic surveillance, which used to be seen as a last resort.

• It allows for preventive arrests.

• It allows judges to compel witnesses to give evidence during an investigation. [? Are we talking torture here ?]

• It allows for the designation of a group as a terrorist organization.

The legislation makes it a crime to:

• Knowingly collect or provide funds, either directly or indirectly, in order to carry out terrorist crimes. Using this definition, the Crown must prove that the accused collected, provided or made available funds that he or she knew would be used to help a terrorist group. Canadian courts would be given the jurisdiction to try this offence even if it were committed outside Canada, when the accused is found in Canada. The maximum sentence for this offence would be 10 years.

• Knowingly participate in, contribute to or facilitate the activities of a terrorist group. The participation or contribution itself does not have to be a criminal offence and would include knowingly recruiting into the group new individuals for the purpose of enhancing the ability of the terrorist group to aid, abet or commit indictable offences. The maximum sentence for the offence of participating or contributing would be 10 years imprisonment. The maximum sentence for facilitating would be 14 years imprisonment.

• Instruct anyone to carry out a terrorist act or an activity on behalf of a terrorist group (a "leadership" offence). This offence carries a maximum life sentence.

• Knowingly harbour or conceal a terrorist. The maximum sentence for this offence would be 10 years.

In addition to the changes to the Criminal Code, the anti-terrorism legislation makes changes to:

The Official Secrets Act - renamed to the Security of Information Act it creates new offences against threats of espionage by foreign powers and terrorist groups and allows ministers to declare certain actions secret.

The Canada Evidence Act - amended to include changes to courtroom and other proceedings to protect classified information.

The National Defence Act - amended to clarify the mandate of the Communications Security Establishment to intercept communication of foreign targets and undertake security checks of government computer networks to protect them from terrorist activity.

UPDATE: Liberal interim leader Bob Rae told reporters in Ottawa Wednesday that if Prime Minister Stephen Harper wanted to bring back the measures he would face a “good debate” in Parliament.

“The Prime Minister needs to explain to us why if these measures were so important and necessary they were not in place for four years,” Rae said. “Is the Prime Minister saying that for the last four or five years we were at risk, at greater risk because the measures have not been in place?”

NDP MP Paul Dewar said in an email to Huffington Post Canada on Tuesday that Harper's plan isn't necessary.

“Stephen Harper's plan to reintroduce these draconian provisions simply isn’t backed up by the facts. The government has produced no evidence to justify this move. Security is obviously important to Canadians, and we can make Canada secure without resorting to measures like these.

“In fact, the former Director of CSIS Reid Morden has said that these provisions were needless and crossed the line between state security and individual rights.”

Harper tried to re-introduce the police-broadening powers in 2008, but his efforts failed in 2008 because the Conservative minority government didn’t have the required seat count. Now that Harper has a majority in both chambers, the hurdle he once faced is no longer an obstacle.

The Liberal caucus was divided over the necessity of the measures four years ago, with some MPs who agreed with the governing Tories sitting out the vote.

The Conservative government will reintroduce controversial anti-terrorism measures that were allowed to expire amid privacy concerns and Charter rights complaints, Prime Minister Stephen Harper confirmed to the CBC Tuesday.

On the eve of the 10th anniversary of the 9/11 terrorist attacks, Harper told CBC’s Peter Mansbridge that Canada needs better tools to combat the ongoing threat of major acts of terrorism and Islamist violence.

Among other controversial measures expected to be made law again are preventative arrests and the ability to force individuals to testify at “investigative hearings” if officials suspect they have knowledge of terrorist activity.

“That is our plan (to reintroduce the measures). We think those measures are necessary. We think they've been useful. And as you know, they're applied rarely, but there are times where they're needed,” said Harper in an interview to be broadcast in its entirety Thursday.

The measures were initially included in the Liberal government’s anti-terrorism act passed soon after 9/11 under then prime minister Jean Chrétien. The controversial provisions of the bill were allowed to expire five years later after a majority of Parliamentarians voted not to reinstate them.

The NDP was especially adamant that the measures were a breach of fundamental freedoms and compromised key features of Canada’s justice system and Charter of Rights and Freedoms.

Investigative hearings provide officials with a way to force someone suspected of having information about terrorist activity to testify before a judge. Preventive detention allows the state to incarcerate anyone suspected of involvement in criminal activity without having to prove allegations. Both provisions gave the government far too much power, the NDP argued.

“Not everyone who chooses to remain silent is guilty. People may have very legitimate fears and concerns, such as fears and concerns about their own personal safety,” then NDP MP Bill Siksay told the House of Commons in 2008 when the Tories first tried to reintroduce the measures.

“Jailing people because we think they might do something criminal is very problematic, to say the least,” he added.

But Harper suggested the measures are a rational response to very real threats faced by Canada.

“The major threat is still Islamicism. There are other threats out there, but that is the one that I can tell you occupies the security apparatus most regularly in terms of actual terrorist threats,” Harper said.

“Now, as we've seen in Norway, terrorist threats can come out of the blue. It can come from something completely different, and there are other groups and individuals that if given the chance would engage in terrorism. But that one is probably still the major one,” he noted.

The Prime Minister said Canada not only faces threats from outside its borders, but also from within, in the form of homegrown terrorists.

“When people think of Islamic terrorism, they think of Afghanistan, or maybe they think of someplace in the Middle East, but the truth is that threat exists all over the world. We've seen some recent bombings in Nigeria, domestic Nigerian terrorists,” Harper said, adding “Homegrown is also something that we keep an eye on.”

In its annual report tabled in June, the Canadian Security Intelligence Service (CSIS) noted that the main threat to Canada continues to be Islamist violence.

"Canada is a tangible target for Islamist extremist-inspired violence," CSIS Director Richard Fadden wrote.

The service was also concerned about terrorist plots being planned by individuals or groups "we do not know about," Fadden said.

Atlantica's Rising Tide

A proposed free-trade area would radically change Canada's East Coast - but would it lift all boats?

Halifax may be the largest city in the Maritimes, but it's hardly a metropolis; home to Dalhousie University, and with a population of just 119,000 people, it feels more like a sleepy college town than a provincial capital. In the early afternoon on June 15, though, about 350 people gathered in a downtown park to wake the city up. The elderly activist group the Maritime Raging Grannies were performing a song composed just for the occasion, sung to the tune of "Go Tell it on the Mountain":

"Come sing it with the sisters / Over the borders everywhere / Atlantica would hurt us / We have to make trade fair / Behind closed doors they'll sign a deal / And we won't know a thing / They'll trample on our human rights / So let our protests ring."

"Atlantica" is a proposed free-trade deal that would further integrate the Maritimes and south-eastern Quebec with the New England states. The agreement was being discussed in Halifax at a conference hosted by one of the deal's main proponents, the right-wing think tank Atlantic Institute for Market Studies (AIMS). While business-people and politicians mingled inside, regular citizens were left on the doorsteps and without a voice in the meetings. "This is an invisible agenda that nobody has really known about up to this point," explained J.D. Price, a spokesperson for the Anti-Atlantica Alliance, the umbrella group that rallied critical voices to come and demonstrate. "The overarching problem is that there’s no transparency, there no participation with civil society. They're talking about scaling back policies and regulations that working class people have fought and struggled for, things like minimum wage and environmental regulations."

As free-trade deals tend to do, Atlantica has generated enough concern to unite a broad cross-section of left-wing activists and concerned citizens; union organizers, environmentalists, parents and children, Canadian nationalists, and militant anarchists all stood in the verdant green park and listened to the Raging Grannies. Some of the anarchists - the self-described "Black Bloc - seemed a bit unsure whether to clap along to the song, or to remain ominous and still. As the demonstration began moving and neared the World Trade and Convention Centre, where the Atlantica conference was being held, this indecisiveness surfaced again.

The 75-strong Black Bloc broke off from the larger march and began running for the Convention Centre, but were blocked by a few police. The events that followed have already been widely reported: someone hurled a smoke bomb at the police, and inexplicably the Bloc ran in the opposite direction, [there are concerns that these protesters dressed in black who cover their faces are people employed by the government to make the genuine protesters look bad] heading toward a busy main road as some desperately yelled, "Where are we going?" Once on the road, protestors pelted businesses and police with paint-filled balloons and light bulbs; the police responded with pepper spray, tazers, billy clubs, and multiple arrests.

A number of protestors dispersed, but some headed north, toward Halifax's iconic Citadel Hill. In the shadow of that landmark, more paint bombs were thrown, and riot police pepper-sprayed and tazered more people, including at least one who was already handcuffed and detained. As a woman was hustled into a police van, she shouted repeatedly, "This is what the police state looks like!"

A man lay on the ground, barely conscious, as police huddled around him, chuckling and cracking jokes. When the paramedics arrived, one turned to a cop and asked, apparently incredulous, "What were you thinking?" Regaining consciousness, the man on the ground croaked to a paramedic, "Tell them to go away," referring to the officers.

Later, at the Convention Centre, about 60 people were gathered on the front steps, shouting chants like, "One-two-three-four, Atlantica is class war! Five-six-seven-eight, organize and smash the state!" Standing with a line of police, a security guard informed the protestors that the Convention Centre is private property; an aboriginal protestor responded, "This is stolen land." One demonstrator, dressed ludicrously in purple goggles, a Hawaiian lei, and a garish skirt, was shoved down the concrete steps by a police officer; he was apparently singled out for violating bail conditions, which dictated that he stay away from the Atlantica conference. The demonstrator began running but was tackled by an undercover cop, dragged behind police lines, and arrested. "You didn't even give me a chance to remove myself from the premises!" he yelled. As other protestors approached, an officer swung his billy club and growled, "Who wants to cross the line?"

By the end of the day, 21 people had been arrested, including at least two who were not involved in the demonstration. Paint splattered the streets, a bank window was broken, and the mainstream media decried the protest as violent. But the Atlantica conference went off without a hitch - in fact, although Atlantica has largely flown beneath the radar prior to the demonstration, the Canadian government announced that week $588,000 in support of the Atlantica Council, which will promote the nascent trade area.

"Atlantica" seems a rather fabulous name for something as unsexy as a trade agreement, but the tale of how it came to the attention of the activist community is nearly as mythic. The rumour goes that, in late 2005, a single East Coast activist discovered AIMS's proposal online and began alerting friends and allies. The pressure of organizing later caused him to suffer a nervous breakdown, but from these humble beginnings blossomed a full-on anti-Atlantica movement.

Atlantica is more officially known as "Atlantica: the International Northeast Economic Region" (AINER) . The brainchild of AIMS, the proposed free-trade area would encompass what is generally described as the "Atlantic Northeast"; in Canada, this would include New Brunswick, Nova Scotia, Quebec south of the St. Lawrence, Newfoundland, and Prince Edward Island; in the U.S., upstate New York, New Hampshire, Vermont, and Maine. Much of the proposal revolves around traditional free-trade proposals like eliminated tariffs, but in many ways Atlantica goes beyond; it is explicitly interested in the "harmonization of regulations" between all involved areas, and in the construction of massive infrastructure projects to facilitate trade.

It is these two areas that have attracted the ire of activists. Atlantica’s detractors point out that, although AIMS cloaks its advocacy of the free-trade zone in the language of job creation and economic revitalization, the think-tank's goals are explicitly anti-poor; it brazenly describes minimum-wage legislation, unionization, and public services as "public policy distress factors." As the Canadian Centre for Policy Alternatives wrote in a comprehensive 2006 report, "This thinly-disguised attack on working people, public services, social programs, and democratic decision-making is very revealing about what underlies the Atlantica agenda."

It is the real-world impacts of these proposed policy changes that drives people like Price to speak up. Although the port of Halifax is central to the trade proposal, Haligonians themselves would not be spared from the effects of dropping salaries and a reduced social security net. "Just in Halifax there are 30,000 people that are a paycheque away from being out on the streets," he explains. "You just have to do the math to understand what's going to happen when minimum wage is brought down, when people are working two jobs, when working poor are struggling to make ends meet as it is."

Beyond such blatantly regressive policy solutions, however, Atlantica would involve massive infrastructure changes to eastern Canada; specifically, the establishment of the Halifax harbour as a major trade conduit between Asia and the eastern U.S. It seems counterintuitive, considering the North American west coast's close proximity to Asian markets and the longstanding use of the Panama Canal, but for AIMS, it makes perfect sense. Trade between Asia and the U.S . keeps rising, straining the capacity of Western ports, and the use of so-called "Post-Panamax" vessels - ships too huge to fit through the Panama Canal - has been on the rise since 1995. Add to this that the Halifax port is deep enough to accommodate Panamax and Post-Panamax ships, and that it is the closest major port for Asian ships travelling via the Suez Canal.

Tied to the revitalization of the Halifax port would be the construction of new highways to accommodate transport trucks ferrying goods from the Maritimes to the eastern U.S., and the loosening of transport regulations to allow increased use of massive "truck trains" - vehicles with more than one trailer per tractor. Atlantica means huge ships and huge trucks – that’s more long-distance trade and more fossil-fuel consumption in the face of climate change's looming threats.

"[The U.S. and Asian] economies are engaged in a trading relationship that's socially, environmentally, and economically unsustainable," Brendan Haley of Halifax's Ecology Action Centre told the crowd on June 15. "The vision of a few business leaders is to take the goods produced halfway around the world and ship them to another country. Nova Scotia becomes a super-highway for the Wal-Marts of the world. Our highest endeavour is to become a middleman."

Free-trade rhetoric at least used to champion market fundamentalism as a cure-all; think of that old cliché, "The rising tide lifts all boats." But Atlantica is not about lifting boats - it is about lifting post-Panamax ships, and allowing everything smaller to drown.

The evening following the main demonstration, a "victory celebration" kegger was held to raise money for legal costs. Beer and vegan burritos sold for $2 apiece, and a local punk band tore through songs with names like "Thrash Atlantica to Fucking Death." A few people joked about how the prisoners, some of whom were straight-edge, would feel about alcohol sales covering their defence fees. A more pressing question, as some present pointed out, was why the party was billed as a victory celebration when so many people were in jail.

But a deeper frustration, one expressed more quietly and privately, was directed towards those who were arrested. More than one person pointed out to me that the arrests were a headache for the anti-Atlantica movement. Some mused about what the most active organizers could be working on after the demonstration, if their time wasn’t being devoted to legal issues. One Black Bloc participant told me that he was dismayed to see a paint bomb explode inches away from an elderly woman. And, of course, the usual questions arose about confrontational, direct action: what about the movement's image? The demonstrations certainly received more press coverage thanks to the minor property damage and clashes with police, but to what end?

The proponents of Atlantica are powerful, and their ideas are uniform; influential think tanks like AIMS, the Nova Scotia and federal governments, and massive corporations like Irving (which, incidentally, owns most of the press in the Maritimes that so readily dismissed the anti-Atlantica actions), all calling for a radically different east coast in the same voice.

The movement against the free-trade area is a more heterogeneous blend of groups united against a single threat. A diversity of views, a diversity of tactics - something to welcome, certainly. But there are also deep strains that plague the movement against Atlantica; the threat of police infiltration, the tension between - as one participant described them - the "punks" and the "activists," the ever-present difficulty of building a coalition that includes both Radical Cheerleader and Raging Granny, anti-capitalist and national sovereigntist. One of the movement’s strengths is surely the wide-ranging groups that it can unify. But if diversity means division, as the aftermath of the demonstration seems to point out, then Atlantica's implementation may be inevitable.

10-4-2009 - I am Bill Bowen the writer and director of the short film, Innocence Destroyed. Thank you for posting this important blog space http://community.kmtr.com/forums/thread/2391609.aspx in order to make more people aware of what is going on in our country and around the world. As well I want to thank all of you who took the time to watch what is a very difficult film to watch. I made it that way because of how hard it was for those children to have had to live those lives and to have been forced to die the way they were forced to die and what they endured. This not the whole story by a long shot. There is a full length film being made right now, "In The Best Interests of the Children." That film documents and details the corruption within CPS, the family courts and the attorneys assigned to "represent" the parents. It also shows the phony "psychologists" who are not even licensed to be able to cut a dog's hair and how CPS and the courts use those paid for hit men to destroy families. It looks into how CPS is destroying Native American families and how they violate the Indian Child Welfare Act and allow white people to adopt Native American babies. As well, how attractive blonde children are taken from parents and given to families of state officials so those families don't have to wait like all others who want to adopt. Stories fully investigated where judges sentenced children to group homes, owned by the judges and those judges don't allow the children to be represented by attorneys. It will exposed the alteration or changing of transcripts from court cases, which are going to appeal and the involvement of the Attorney General's offices in some sates and their zeal to win cases at any cost. There is a lot more on those AGs. How CPS controls the various state legislators and that is due to the matching funds wherein the states receive three federal dollars for every state dollar they give CPS. The film will provide even more shocking details about the murders of the children shown in the short film and will expose even more cases of the same type of murders, plus torture, rape of little children and the involvement of CPS in too many of those rapes, abuses and murders or deaths due to neglect. It will update the retaliation against some of those people who appeared in the short film by the courts and CPS and how those brave people continue to fight. Most importantly, the full length film, with the help of caring, current legislators, attorneys, doctors and former CPS caseworkers will provide a workable solution to all of the problems associated with CPS and there is nothing CPS can do to stop that solution, nothing any legislative body can do to stop it or any lobbyists can do to stop it. It doesn't require any donations, zero, zippo, nada, honestly nothing! You will not be asked to write letter or protest and march as that is joke to CPS, but the proposed solution will handle the problems of CPS once and for all. Please watch for that film and in the meantime, please try and get this short film out to as many people as you can, politicians, media people, talk show host of all stripes and keep increasing the public awareness. These CPS creatures can only operate in darkness and shadows. Let's shine the strong light of day on them. Your help is certainly acceptable to us. Most of the time, Nick Finney 's job is to respond to rapid-onset humanitarian disasters — floods, earthquakes and health emergencies. But in First Nations communities in northern Canada last winter he witnessed “the slowest evolved disaster that I've ever worked in.”

Finney, based in Britain, is Save the Children's acting head of emergency capacity. He was invited by the remote communities to visit and conduct international aid–style assessments. “At first, it seemed like my work in Kenya after the flood — creating a multidisciplinary team of locals and others, taking a plane to remote communities,” he said in a telephone interview from London. “But this disaster goes back to the last century. The level of deprivation is truly shocking. We visited a damp, 1-bedroom house with a family of 25 living in it.”

The aid worker compared what he saw in Canada with regions that had endured years of conflict. “ In a natural disaster, hope is a vital thing. People lose family and possessions, but society is united with those who can help. What I felt in northern Canada was like Darfur. The reasons are different, but there is a hopelessness, a despair, a sense of despondency.” Finney stressed that he also saw “powerful leadership” in the communities he visited, but said while “they are fighting hard, they need some help.”

Finney is far from the first to compare the living conditions of Canada's Aboriginal peoples with those in the Third World. The United Nations' Human Development Index, a standard measure that ranks the well-being of member states, placed Canada number 6 among 192 nations in 2006.

But when the same formula is applied to data about the living conditions of Canada's First Nations, a very different story emerges: in 2001 that ranking was number 76.

“Aboriginal people endure ill health, run-down and overcrowded housing, polluted water, inadequate schools, poverty and family breakdown at rates found more often in developing countries than in Canada. These conditions are inherently unjust.” That passage was from the extensive 1996 Royal Commission on Aboriginal Peoples, which was co-chaired by Georges Erasmus, the former president of the Dene Nation and former National Chief of the Assembly of First Nations, which represents on-and off-reserve Aboriginals (but not Inuit) in Canada.

A recent Assembly of First Nations “report card” on the government's response to the Royal Commission recommendations is damning: “The reality for First Nations communities today is ongoing poverty and an increasing gap in living conditions with other Canadians, which were reported during the RCAP [Royal Commission on Aboriginal Peoples] hearings.”

Just last month, Canada voted against a United Nations declaration on Aboriginal rights, while the 2005 Kelowna Accord, an ambitious plan to close the gap between mainstream Canada and Aboriginals, was rejected by the federal Conservative government.

The $5.4-billion accord had been endorsed by the federal, provincial and territorial governments in Canada under the previous Liberal government.

“I am very, very disappointed that Prime Minister Harper could not support Kelowna.… We call on all good people to continue to press this issue,” Assembly of First Nations National Chief Phil Fontaine told a nursing conference last August.

Canada has repeatedly come under fire from the United Nations committee on economic, social and cultural rights for the living conditions of Aboriginals.

In 1998, it called for an urgent national strategy on the issue and, in 2006, it expressed “shock and dismay” at the lack of progress in this area.

The harsh numbers are unchanged

Tragedies among Canada's Aboriginal population are often treated as isolated events and there is an illusion that “progressive thinking and improved attitudes have brought fair treatment to Canada's native peoples.” That statement is from journalist Geoffrey York's book, The Dispossessed: Life and death in native Canada, which was published 18 years ago. Current statistics continue to challenge that illusion:

The average income of the Aboriginal population was less than half that of the non-Aboriginal Canadian population in 2000 ($14 157 compared to $30 062), according to Statistics Canada.

The Inuit had slightly higher than Aboriginal-average incomes ($19 878) in 2000, but have larger families (39% of Inuit are under age 15, compared to 19% of all Canadians) and face significantly higher costs of living. For example, the same staple foods cost more than 3 times as much in Clyde River, Nunavut, than in Ottawa ($31.22 compared to $9.47), according to Inuit Tapirisat Kanatami figures.

Fully 92 of the bottom 100 Canadian communities, measured in terms of community well-being, were First Nations communities, according to calculations by Indian and Northern Affairs Canada.

Aboriginals living in urban areas of Canada are more than twice as likely to be living in poverty than other Canadians, according to the Canadian Council on Social Development.

About 3.3% of Canada's population is Aboriginal, more than in Australia (2.2%) and the United States (1.5%), according to the 2001 Census.

In Canada, the term “Aboriginal” is used to encompass First Nations, Métis and Inuit, and the 2001 Census put their total population at about 1 million. Métis typically describes those of mixed (Indian and non-Indian) ancestry who self-identify as Métis, and Inuit are the Aboriginal people of Arctic Canada.

The term First Nations, however, while formally referring to Status and Non-Status Indians, is also sometimes used more broadly to include Métis. According to the 2001 Census, Inuit (then numbering about 45 000) make up about 5% of the Aboriginal population, Métis account for about 30% and North American Indian most of the balance.

Previous Section Extending an invitation, and a hand

Consider yourself invited to Webequie, a First Nations community 540 kilometres north of Thunder Bay, Ont., with a population of about 700. Chief Scott Jacob would be pleased to show off his home to anyone who can find their way there because “we really want people in the south to better understand what is happening. You have to see for yourself. I think people just don't believe what is written in the papers.”

Since 1997, 27 young people have committed suicide in Webequie. Jacobs' efforts to raise money to establish a healing centre to deal with the resulting trauma have so far been unsuccessful.

Many houses are in very bad shape and the recent assessment report recommended that 100 new houses be built. The current electrical supply, however, can't accommodate such construction, though Jacobs hopes to have a new electrical plant in a year. Meanwhile Webequie, located on an island on Winisk Lake, is accessible only by air for most of the year, which means supplies must be flown in and costs are high: gas is $2.40 a litre.

The assessment report on Webequie was conducted under the auspices of the North-South Partnership for Children. The partnership was founded last year to link members of remote communities with local and international foundations, organizations and individuals, to build cultural understanding and mobilize resources.

Co-founder Judy Finlay, former child advocate for Ontario, was frustrated by the intransigence of government and the lack of movement in communities she had visited for 2 decades.

“Up north, there is no United Way, no Family Service Association to help people — there is nothing but government.” To date the partnership has sent $1.5-million worth of resources like food, clothing and recreational equipment to communities, said Finlay, now a professor at Ryerson University in Toronto.

Webequie has received tangible benefits: a Guelph, Ont., group recently raised $2800 for musical instruments, and 8 canoes were donated to the island settlement to be used in a fall program that sees youth taken to the bush to learn traditional ways. Jacobs says he was particularly touched by a partnership donation last winter.

“There had been a lot of unemployment, and just before Christmas they sent up wrapped gifts for the children. Young mothers came by and you could really see them smiling.”
